PASAL 1
Kewajiban untuk Mengekstradisi 1. Tiap-tiap Pihak sepakat untuk melakukan ekstradisi kepada Pihak lainnya, sesuai dengan ketentuan Perjanjian ini dan hukum domestiknya masing- masing, setiap orang yang ditemukan berada di wilayah Pihak Diminta dan dicari oleh Pihak Peminta untuk penuntutan, persidangan, atau pelaksanaan hukuman untuk tindak pidana yang dapat diekstradisikan, meskipun tindak pjdana tersebut dilakukan sebelum atau setelah berlakunya Perjanjian ini. 1 2. Jika tindak pidana dimana ekstradisinya dimintakan telah dilakukan diluar wilayah para Pihak, ekstradisi harus dikabulkan berdasarkan ketentuan Perjanjian ini, jika terhadap orang yang dimintakan ekstradisinya adalah warg:a negara Pihak Peminta. Jika terhadap orang yang dimintakan ekstradisinya terkait dengan tindak pidana tersebut bukan warga negara Pihak Peminta, Pihak Diminta dapat, dengan diskresinya, mengabulkan ekstrad isi. Pasal2 Tindak Pidana yang Diekstradisikan 1. Tindak pidana yang diekstradisikan adalah tindakan yang dihukum oleh ketentuan hukum kedua Pihak dengan penjara atau pembatasan kebebasan untuk masa hukuman paling sedikit 1 (satu) tahun, atau dengan hukuman yang lebih berat. 2. Suatu tindak pidana juga merupakano tindak pidana yang dapat diekstradisikan, apabila tindak pidana tersebut meliputi suatu percobaan atau permufakatan jahat untuk melakukan, pembantuan atau penganjuran, pemberian nasihat atau pemberian kesempatan, atau penyertaan untuk melakukan tindak pidana sebagaimana tersebut pada ayat1 Pasal ini. 3. Dalam menentukan apakah suatu perbuatan merupakan tindak pidana berdasarkan hukum kedua Pihak, tidak menjadi persoalan apakah: (a) hukum kedua Pihak menempatkan perbuatan atau kelalaian yang dituduhkan dalam golongan tindak pidana yang sama atau menyebutkan tindak pidana tersebut dengan terminologi yang sama (b) berdasarkan hukum kedua Pihak unsur-unsur dasar tindak pidana tersebut memiliki perbedaan. Keseluruhan perbuatan yang dituduhkan tersebut akan dipertimbangkan 2 4. Apabila permintaan ekstradisi merujuk pada sejumlah tindak pidana dan beberapa di antaranya tidak dapat dihukum dengan pidana penjara untuk jangka waktu paling sedikit 1 (satu) tahun berdasarkan hukum kedua Pihak, ekstradisi dapat dikabulkan untuk semua tindak pidana apabila memenuhi persyaratan lainnya sebagaimana diatur dalam Perjanjian ini dan termasuk pengabulan ekstradisi untuk sekurang-kurangnya satu tindak pidana yang dapat diekstradisikan. 5. Ekstradisi dapat dikabulkan berdasarkan ketentuan dalam Perjanjian ini dengan tidak memperhatikan pada saat kapan tindak pidana terkait kepada ekstradisinya dimintakan tersebut dilakukan sepanjang apabila tindak pidana tersebut dilakukan sebelum Perjanjian ini diberlakukan, tindak pidana pada saat tersebut bertentangan dengan hukum kedua Pihak. 6. Dalam hal ekstradisi dimintakan terhadap seseorang untuk suatu tindak pidana yang berkaitan dengan perpajakan, bea cukai, pengawasan valuta asing, atau masalah-masalah penghasilan lainnya, ekstradisi tidak dapat ditolak dengan alasan bahwa hukum dari Pihak Diminta tidak menerapkan pajak atau bea yang sama atau tidak mengatur ketentuan-ketentuan pajak, bea cukai, atau pertukaran valuta asing yang serupa dengan hukum di Pihak Peminta. 7. Tanpa mengurangi ketentuan dalam ayat 3 Pasal 8 Perjanjian ini terkait dengan jurisdiksi yang mendasari tindak pidana, suatu tindak pidana dapat diekstradisikan berdasarkan Perjanjian ini, tanpa mempertimbangkan apakah perbuatan yang dituduhkan kepada orang yang diminta telah dilakukan secara keseluruhan atau sebagian di wilayah Pihak Diminta, apabila berdasarkan hukum Pihak Diminta, perbuatan dan akibat yang ditimbulkannya, atau akibat yang dikehendaki, secara keseluruhan dianggap sebagai tindak pidana yang terjadi di wilayah Pihak Peminta. 8. Apabi 1la permintaan ekstradisi diajukan untuk melaksanakpn hukuman yang telah diputuskan, sisa masa hukuman yang harus dijalani dalam tindak 3 pidana yang diajukan ekstradisi tersebut tidak kurang dari 6 (enam) bulan . Pasal3 Kejahatan Politik 1. Seseorang tidak akan diekstradisikan jika kejahatan yang dimintakan ekstradisinya itu merupakan kejahatan politik atau yang karena keadaan dimana kejahatan yang diduga telah dilakukan atau telah dilakukan itu, merupakan kejahatan yang bernuansa politik. 2. Jika timbul persoalan apakah suatu perkara merupakan kejahatan politik atau kejahatan yang bersifat politik, maka keputusan pejabat yang berwenang dari Pihak Diminta akan bersifat menentukan. 3. Menurut Perjanjian ini, tindak pidana berikut tidak termasuk sebagai tindak pidana politik: a. tindak pidana terhadap nyawa atau diri Kepala Negara atau Kepala Pemerintahan atau keluarga inti; b. tindak pidana berdasarkan konvensi internasional dalam hal Para Pihak memiliki kewajiban dengan menjadi Negara Pihak dalam konvensi tersebut, untuk melakukan ekstradisi atau melakukan penuntutan terhadap orang yang diminta atau menyerahkan perkara tersebut tanpa penundaan kepada otoritas yang berwenang untuk tujuan penuntutan; c. tindak pidana terkait terorisme yang pada saat permintaan diajukan adalah, berdasarkan hukum Pihak Diminta, tidak dianggap tindak pidana tersebut sebagai tindak pidana politik; d. percobaan atau permufakatan jahat untuk melakukan setiap tindak pidana sebagaimana tersebut atau turut serta dalam pembantuan 4 I kepada seseorang yang melakukan atau mencoba untuk melakukan tindak pidana tersebut. 4. Tindak pidana berat terhadap tubuh, orang, nyawa dan harta benda, tidak akan dianggap sebagai tindak pidana politik menurut Perjanjian ini. Pasal4 Ekstradisi Warga Negara 1. Para Pihak memiliki hak untuk menolak ekstradisi terhadap warga negaranya. 2. Jika Pihak Diminta tidak mengekstradisi warganegaranya, Pihak tersebut harus, atas permintaan Pihak Peminta menyerahkan perkaranya kepada pejabat yang berwenang dari Negara yang Diminta untuk penuntutan. Untuk maksud ini, berkas perkara, informasi dan bukti-bukti mengenai kejahatan itu harus diserahkan oleh Pihak Peminta kepada Pihak Diminta. 3. Dengan tidak mengurangi ketentuan ayat 2 Pasal ini, Pihak Diminta tidak diwajibkan untuk menyerahkan perkara itu kepada pejabat yang berwenang untuk melakukan penuntutan atau pelaksanaan hukuman jika pejabat yang berwenang itu tidak mempunyai yurisdiksi. Jika pejabat yang berwenang itu tidak mempunyai yurisdiksi,Pihak Diminta harus mengekstradisi orang yang dimaksud. 4. Untuk tujuan dalam pasal ini, kewarganegaraan seseorang yang dimintakan harus mengutamakan pertimbangan dengan berdasarkan kewarganegaraanya pada saat perbuatan tindak pidana dilakukan terkait dengan ekstradisi yang dimintakan. 5 Pasal5 Non Bis in Idem Ekstradisi atas seseorang tidak akan diberikan jika orang itu telah diadili dan diputus bebas atau dibebaskan dari segala tuntutan oleh peradilan atau pengadilan yang berwenang, atau telah menjalani hukuman di Pihak Diminta atau di negara ketiga sehubungan dengan perbuatan atau kealpaan yang merupakan kejahatan yang dapat dimintakan ekstradisinya. Pasal6 Asas Kekhususan 1. Seseorang yang diekstradisi berdasarkan Perjanjian ini tidak boleh untuk menjalani pemeriksaan yang bertentangan, dihukum, ditahan, diekstradisikan ke negara ketiga, atau dikenakan pembatasan kebebasan lainnya di wilayah Pihak Peminta untuk kejahatan lain yang dilakukan sebelum penyerahan kecuali untuk: (a) Tindak pidana dimana ekstradisinya telah diberikan; (b) Tindak pidana lainnya dengan terlebih dahulu meminta persetujuan Pihak Diminta. 2. Permintaan persetujuan dari Pihak Diminta berdasarkan Pasal ini wajib menyertakan dokumen-dokumen sebagaimana dimaksud dalam ayat 2 Pasal 10. 3. Ayat 1 Pasal ini tidak diberlakukan jika orang tersebut telah memiliki kesempatan untuk meninggalkan wilayah Pihak Peminta dan tidak melakukannya dalam waktu 30 (tiga puluh) hari sejak pelepasan terakhir terkait dengan tindak pidana yang menjadi dasar orang tersebut diekstradisikan atau jika orang tersebut telah kembali secara sukarela ke wilayah Pihak Peminta. 6 I I Pasal7 Dasar Penolakan Wajib Ekstradisi wajib tidak diberikan dalam keadaan sebagai berikut: (a) Jika tindak pidana dimana ekstradisinya dimintakan terkait dengan tindak pidana politik sebagaimana dimaksud dalam Pasal 3; (b) Jika terdapat alasan yang mendasari bahwa permintaan telah dibuat untuk menuntut atau menghukum seseorang berdasarkan ras, agama, kewarganegaraan, asal-usul etnis, pandangan politik, atau orang tersebut patut diduga akan mendapatkan perlakuan tidak adil dan berlebihan dalam menjalani penuntutan atau hukuman; (c) tindak pidana yang dimintakan ekstradisi adalah tindak pidana militer, yang bukan merupakan tindak pidana dalam hukum pidana umum; (d) Jika putusan yang berkekuatan hukum tetap telah dijatuhkan kepada orang yang diminta terkait dengan tindak pidana yang dimintakan ekstradisi; (e) Jika orang yang dimintakan ekstradisi, berdasarkan hukum di Negara Peminta, tidak dapat dituntut karena daluwarsa atau adanya pengampunan; (f) Jika keputusan pengadilan pada Pihak Peminta diberikan secara in absensia, kecuali bagi terpidana telah diberikan pemanggilan yang cukup atas peradilannya atau kesempatan untuk melakukan pembelaan. Pasal8 Dasar Penolakan Diskresi 1. Ekstradisi dapat ditolak dalam keadaan sebagai berikut: (a) Jika orang yang diminta untuk diekstradisikan adalah warga negara 7 dari Pihak Diminta; (b) Jika penyidikan dan penuntutan sedang dilakukan di Pihak Diminta terkait dengan tindak pidana dimana ekstradisinya dimintakan; (c) Jika tindak pidana dimana ekstradisinya dimintakan, dihukum dengan hukuman mati berdasarkan hukum Pihak Peminta, sementara berdasarkan hukum Pihak Diminta tindak pidana tersebut tidak dihukum dengan hukuman mati, kecuali Pihak Peminta memberikan jaminan bahwa apabila orang tersebut dijatuhi hukuman mati, hal tersebut tidak akan dilaksanakan; (d) Jika tindak pidana telah dilakukan diluar wilayah kedua Pihak dan hukum di Pihak Diminta tidak memiliki jurisdiksi terhadap seluruh tindak pidana yang dilakukan di luar wilayahnya; (e) Jika tindak pidana dianggap berdasarkan hukum Pihak Diminta telah dilakukan untuk keseluruhan atau sebagian di dalam wilayah Pihak Diminta; (f) Jika ekstradisi akan bertentangan dengan pertimbangan kemanusiaan berdasarkan usia, kesehatan atau kondisi pribadi lainnya dari orang terse but.
2. Ayat 1 (a), (e) Pasal ini tidak berlaku apabila tindak pidana dimana penyerahannya dimintakan terkait dengan salah satu perbuatan: (a) bertentangan dengan hukum terkait dengan tindakan teroris; (b) penyuapan atau perbuatan terkait korupsi lainnya; atau (c) dalam hal mana terjadi kerugian besar (kerusakan atau cedera) yang ditimbulkan dari atau dimaksudkan oleh perbuatan tindak pidana di 8 wilayah Pihak Peminta. 3. Ekstradisi dapat ditolak apabila Pihak Diminta memiliki yurisdiksi atas tindak pidana yang dimintakan ekstradisi sesuai dengan hukum nasionalnya. Dalam keadaan tersebut, Pihak Diminta memiliki kewajiban untuk menuntut pelaku ke Pengadilan atas tindak pidana yang diajukan ekstradisinya sesuai dengan hukum nasionalnya. Dalam hal otoritas berwenang dari Pihak Diminta memutuskan untuk tidak menuntut atau apabila penuntutan tidak dapat dilaksanakan atas alasan apa pun, maka permintaan ekstradisi harus dipertimbangkan kembali. Pasal9 Otoritas Pusat 1. Masing-masing Pihak harus menunjuk Otoritas Pusat untuk tujuan pelaksanaan Perjanjian ini. 2. Untuk Republik Indonesia, Otoritas Pusat adalah Kementerian Hukum dan Hak Asasi Manusia dan untuk Papua Nugini adalah Departemen Kehakiman dan Jaksa Agung.
PASAL 19
Bantuan Timbal Balik Tiap-tiap Pihak harus, sepanjang diperbolehkan oleh hukum nasionalnya, saling memberikan bantuan timbal balik dalam masalah pidana seluas-luasnya terkait dengan tindak pidana untuk ekstradisi yang telah dimintakan. Pasal20 Transit 1. Sepanjang diperbolehkan oleh hukum nasionalnya, transit seseorang yang akan diekstradisi dari suatu negara ketiga ke salah satu Pihak melalui wilayah Pihak lainnya akan diizinkan berdasarkan permintaan yang disampaikan melalui saluran diplomatik atau secara langsung melalui 15 I I I I Otoritas Pusat Para Pihak. lzin transit tidak diperlukan dalam penggunaan transportasi udara dan tidak ada pendaratan yang dijadwalkan di wilayah Pihak yang digunakan sebagai tempat transit. 2. Jika terjadi pendaratan tidak terjadwal di wilayah Pihak tersebut, Pihak tersebut dapat mensyaratkan Pihak lainnya untuk melengkapi permintaan transit sebagaimana ditetapkan pada ayat 1 Pasal ini. Pihak tersebut dapat, sepanjang tidak bertentangan dengan hukum nasionalnya, menahan orang yang akan diekstradisi tersebut untuk jangka waktu 72 (tujuh puluh dua) jam sambil menunggu permintaan transit. Pasal21 Permintaan Bersamaan 1. Bila beberapa permintaan diterima dari dua negara atau lebih untuk mengekstradisikan orang yang sama, baik untuk kejahatan yang sama, atau untuk kejahatan yang berbeda, Pihak Diminta wajib menentukan kepada negara mana orang itu harus diekstradisikan dan harus memberitahu Pihak Peminta mengenai keputusannya. 2. Dalam menentukan kepada negara mana seseorang akan dikestradisi, Pihak Diminta harus memperhatikan semua keadaan yang berkaitan dan, termasuk: (a) jika permintaan terkait dengan tindak pidana yang berbeda; (b) tingkat dan keterkaitan terhadap keseriusan tindak pidana; (c) waktu dan tempat terjadinya tiap-tiap tindak pidana; (d) tanggal permintaan dimaksud; (e) kewarganegaraan orang dimaksud; 16 (f) kebiasaan tempat kediaman orang tersebut; (g) kemungkinan ekstradisi yang berikutnya ke negara lain; dan (h) jika permintaan telah dibuat berdasarkan suatu perjanjian. Pasal22 Bia ya Biaya yang timbul dari prosedur ekstradisi pada Pihak Diminta akan ditanggung oleh Pihak tersebut. Biaya transportasi dan biaya transit yang berhubungan dengan penyerahan atau pengambilalihan orang yang diekstradisi akan ditanggung oleh Pihak Peminta. Pasal23 Kewajiban lnternasional Perjanjian ini tidak akan mempengaruhi hak dan kewajiban Para Pihak mengenai ekstradisi berdasarkan konvensi internasional atau pengaturan lainnya yang dalam hal ini mereka menjadi pihak. Pasal24 Penyelesaian Perbedaan Setiap perbedaan yang timbul akibat penafsiran atau pelaksanaan Perjanjian ini akan diselesaikan melalui konsultasi antara Para Pihak. Pasal25 Perubahan dan Peninjauan Kembali 1. Perjanjian ini dapat ditinjau kembali berdasarkan mekanisme yang disepakati antara Pihak. 17
2. Perjanjian ini dapat diubah dengan kesepakatan tertulis antara Pihak. Amandemen tersebut harus diberlakukan dengan prosedur yang sama seba~ limana diberlakukan untuk pemberlakuan Perjanjian ini. Pasal26 Mulai Berlaku dan Berakhirnya Perjanjian
1. Perjanjian ini mulai berlaku 30 (tiga puluh) hari setelah tanggal pe1.1beritahuan terakhir dari Pihak yang saling memberitahukan secara tert..11is bahwa masing-masing persyaratan mereka untuk mulai berlakunya pe~ ar Jan ini telah dipenuhi. 2. Salah satu Pihak dapat mengakhiri Perjanjian ini kapanpun melalui periberitahuan secara tertulis melalui saluran diplomatik kepada Pihak lainnya dan hal tersebut harus berakhir untuk diberlakukan 6 (enam) bulan setelah diterimanya pemberitahuan mengenai pengakhiran. Pengakhiran Perjanjian ini tidak akan mempengaruhi permintaan ekstradisi yang telah disampaikan sebelum pengakhiran Perjanjian ini. SEBAGAI BUKTI, yang bertanda tangan di bawah ini, diberi kuasa oleh Pemerint· ·1nya masing-masing, telah menandatangani Perjanjian ini. INDONESIA EXTRADITION TREATY BETWEEN THE REPUBLIC OF INDONESIA AND THE INDEPENDENT STATE OF PAPUA NEW GUINEA The Republic of Indonesia and the Independent State of Papua New Guinea (hereinafter referred to as the "Parties") DESIRING to strengthen the existing friendly relations between the two countries and to make more effective cooperation between the two countries in the suppression of crime and specifically, to regulate and promote relations between them on matters of extradition on the basis of mutual respect for sovereignty, equality and mutual benefit. HAVE AGREED AS FOLLOWS: Article 1 Obligation to Extradite 1. Each Party agrees to extradite to the other Party, subject to the provisions of this Treaty and their respective domestic laws, any person who is found in the territory of the Requested Party and sought by the Requesting Party for prosecution, trial, or execution of punishment for an extraditable offence, whether such offence was committed before or after the entry into force of this Treaty. 1 2. If the offence for which extradition is requested has been committed outside the territory of the Parties, extradition shall be granted subject to the provisions of this Treaty, if the person whose extradition is requested is a national of the Requesting Party. If the person whose extradition is requested in respect of such an offence is not a national of the Requesting Party, the Requested Party may, in its discretion, grant extradition. Article 2 Extraditable Offences 1. Extraditable offences are those punishable under the laws of both Parties by imprisonment or deprivation of liberty for a minimum period of at least 1 (one) year, or by a more severe penalty. 2. An offence shall also be an extraditable offence, if it consists of an attempt or a conspiracy to commit, aiding or abetting, counselling or procuring the commission of or being an accessory to the commission of an offence described in paragraph 1 of this Article. 3. In determining whether or not an offence is punishable under the laws of both Parties, it shall not matter whether: (a) the laws of both Parties place the acts or omissions constituting the offence within the same category of offence or denominate the offence by the same terminology; (b) under the laws of the Parties the constituent elements of the offence differ. It is the totality of the acts or omissions that shall be taken into account. 2 4. If the request for extradition includes several offences and some of them are not punishable for at least 1 (one) year imprisonment under the law of both Parties, extradition may be granted for all offences if they meet other requirements in accordance with the provisions of the Treaty and includes grant of extradition for at least one extraditable offence. 5. Extradition may be granted pursuant to the provisions of this Treaty irrespective of when the offence in relation to which extradition sought is committed provided that if the offence was committed before this Treaty enters into force, it was at the time an offence against the laws of both Parties. 6. Where extradition of a person is sought for an offence against a law relating to taxation, customs duties, foreign exchange control or other revenue matters, extradition may not be refused on the grounds that the law of the Requested Party does not impose the same kind of tax or duty or does not provide for a tax, duty, customs or foreign exchange regulation of the same kinds as the laws of the Requesting Party. 7. Without prejudice to paragraph 3 of Article 8 of this Treaty regarding jurisdiction over the offences, an offence would be extraditable under this Treaty, notwithstanding that the conduct of the person sought occurred wholly or in part in the Requested Party, if under the law of that Party this conduct and its effects, or its intended effects, taken as a whole, would be regarded as constituting the commission of an extraditable offence in the territory of the Requesting Party. 8. Where the extradition request is aimed at executing a sentence imposed, the sentence remaining to be served in an extraditable offence must not be less than 6 (six) months. 3 I I I I I I Article 3 Political Offences
1. A person shall not be extradited if the offence for which his or her extradition is requested is a political offence or by reason of the circumstances in which it is alleged to have been committed or was committed, is an offence of a political nature. 2. If any question arises as to whether a case is of a political offence or an offence is of a political character, the decision of the authorities of the Requested Party shall be determinative.
3. For the purpose of this Treaty, the following shall not be considered as political offences:
a. an offence against the life or person of the Head of State or the Head of Government or member(s) of their immediate family;
b. an offence under any international convention to which the Parties have the obligation by virtue of becoming a State Party thereto, to either extradite or prosecute the person sought or submit the case without undue delay to their competent authorities for the purpose of prosecution;
c. an offence related to terrorism which at the time of the request is, under the law of the Requested Party, not to be regarded as an offence of a political character;
d. an attempt or conspiracy to commit any of the foregoing offences or participation as an accomplice of a person who commits or attempts to commit such an offence. 4 4. Serious offences against the body, person, life and property shall not be considered as political offence/s for the purpose of this Treaty. Article 4 Extradition of Nationals 1. Each Party shall have the right to refuse extradition of its nationals. 2. If the Requested Party does not extradite its nationals, that Party shall, at the request of the Requesting Party submit the case to the competent authorities of the Requested Party for prosecution. For this purpose, the files, information and exhibits relating to the offence shall be surrendered by the Requesting Party to the Requested Party. 3. Notwithstanding paragraph 2 of this Article, the Requested Party shall not be required to submit the case to its competent authorities for prosecution or for the imposition or enforcement of sentence if the authorities have no jurisdiction. If it does not have jurisdiction, the Requested Party shall extradite the person. 4. For the purpose of this article, nationality of the person sought shall be strongly considered on the basis of his/her nationality at the time of the commission of the offence for which extradition is requested. Article 5 Double Jeopardy Extradition of a person shall not be granted when he or she has already been tried and discharged or acquitted by a competent court or tribunal, or has already undergone punishment in the Requested Party or in a third state for the act or omission constituting the offence for which his or her extradition is requested. 5 Article 6 Rule of Speciality 1. A person extradited under this Treaty shall not be proceeded against, sentenced, detained, re-extradited to a third state, or subjected to any other restriction of personal liberty in the territory of the Requesting Party for any offence committed before surrender other than: (a) An offence for which extradition was granted; (b) Any other offence in respect of which the Requested Party consents.
2. A request for consent of the Requested Party under this Article shall be accompanied by the documents mentioned in paragraph 2 of Article 10. 3. Paragraph 1 of this Article shall not apply if the person has had an opportunity to leave the territory of the Requesting Party and has not done so within 30 (thirty) days of final discharge in respect of the offence for which that person was extradited or if the person has voluntarily returned to the territory of the Requesting Party. Article 7 Mandatory Grounds for Refusal Extradition shall not be granted in any of the following circumstances: (a) If the offence for which extradition sought is regarded as a political offence as contained in Article 3; (b) If there are grounds to believe the request has been made to prosecute or punish a person on account of that person's race, religion, nationality, ethnic origin, political opinions, or that the person may be prejudiced by 6 I I excessive or unjust prosecution or punishment; (c) If the offence is an offence under military law which is not also an offence under ordinary criminal law; (d) If final judgment has been rendered against the person in the Requested Party in respect of offences for which the persons' extradition is requested; (e) If the person whose extradition has been requested has, under the law of the Requesting Party, cannot be prosecuted because of lapse of time or pardon; (f) If the judgment in the Requesting Party has been rendered in absentia, unless the convicted person has had sufficient notice of the trial or opportunity to arrange for a defence. Article 8 Discretionary Grounds for Refusal 1. Extradition may be refused in any of the following circumstances: (a) If the person whose extradition is requested is a national of the Requested Party; (b) If the investigation and prosecution is in progress in the Requested Party in respect of the offence of which extradition is sought; (c) If the offence for which extradition is requested, is punishable by death penalty under the law of the Requesting Party, while under the law of the Requested Party such offence is not punishable by death penalty, unless the Requesting Party gives an assurance that if that 7 person is awarded the death penalty, the same will not be carried out; (d) If the offence has been committed outside the territory of either Party and the law of the Requested Party does not provide for jurisdiction over such an offence committed outside its territory; (e) If the offence is regarded under the law of the Requested Party as having been committed in whole or in part within the territory of the Requested Party; (f) If extradition would be incompatible with humanitarian considerations in view of age, health or other personal circumstances of that person.
2. Paragraph 1 (a), (e) of this Article shall not apply where the offence for which the surrender is sought is one: (a) against laws relating to terrorist acts; (b) of bribery and other related acts of corruption; or (c) in respect of which substantial harm (damage or injury) arising from or intended by the commission of the offence is in the territory of the Requesting party. I I 3. Extradition may not be granted where the Requested Party has jurisdiction 1 1 over the offence for which the extradition is requested, under its national law. In such a situation, the Requested Party shall have the obligation to prosecute the person wanted in respect of the offence/s sought for in its courts in accordance with its laws. If the competent authorities of the requested Party decide not to prosecute in such a case or the prosecution is not feasible for whatever reason the request for extradition shall be reconsidered. 8 1 1 1 1 Article 9 Central Authorities 1. Each Party shall designate a Central Authority for the purpose of the implementation of this Treaty. 2. For the Republic of Indonesia, the Central Authority shall be the Ministry of Law and Human Rights and for the Independent State of Papua New Guinea, the Central Authority shall be the Department of Justice and Attorney General. Article 10 Extradition Procedure and Required Documents 1. A request for extradition shall be made in writing and transmitted, along with supporting documents, through diplomatic channels between Central Authorities. All documents submitted in support of a request for extradition shall be authenticated in accordance with Article 12. 2. A request for extradition shall be accompanied by the following: (a) In all cases: (i) As accurate as possible, a description of the person sought and information to help establish that person's identity, nationality and location; (ii) The text of the relevant provision of the law creating the offence and a statement of the penalty that can be imposed; (b) If a warrant for arrest has been issued, by a certified copy of that warrant, a statement of the offence for which extradition is requested and a description of the acts or omissions constituting the alleged offence; 9 11 (c) If the person has been convicted, by a statement of the offence and a description of the acts or omissions constituting the offence and by the original or certified copy or the judgment; (d) If the person has been convicted in his or her absence, in addition to the documents set out in paragraph 2 (c), by a statement as to the legal means available to the person to prepare a defence; ( e) If the person has been convicted but no sentence imposed, by a statement of the offence, a document setting out the conviction and a statement affirming intent to impose a sentence. 3. Where necessary, the documents submitted in support of a request for extradition shall be accompanied by a translation into the language of the Requested Party. Article 11 Additional Information 1. If the Requested Party considers that the information furnished in support of a request for extradition is not sufficient in accordance with this Treaty to enable extradition to be granted, that Party may request that additional information be furnished within 30 (thirty) days after the Requesting Party receives such notification from Requested Party. 2. If the person whose extradition is sought is under arrest and the additional information furnished is not sufficient in accordance with this Treaty or is not received within the time limit specified, the person may be released from custody. Such release shall not preclude the Requesting Party from making a fresh request for extradition of the person. 10 3. Where the person is released from custody in accordance with paragraph 2 of this Article, the Requested Party shall notify the Requesting Party as soon as practicable. Article 12 Authentication of Documents 1. A document that is furnished in support of a request for extradition shall be admitted, if authenticated, in any extradition proceedings in the Requested Party. 2. A document is authenticated for the purpose of this Treaty if: (a) It purports to be signed or certified by competent authority of the Requesting Party. (b) It is sealed with the official seal of the competent authority of the Requesting Party Article 13 Voluntary Surrender When a person sought explicitly consents before the court during extradition proceedings that he/she volunteers to be surrendered to the Requesting Party, the Requested Party, subject to its national law, may surrender the person as expediti,ously as possible without further extradition proceedings. Article 14 Provisional Arrest 1. In case of urgency, the Requesting Party may apply for provisional arrest of the person sought pending the submission of the request for extradition. Such request may be submitted in writing through diplomatic channel, the 11 I 1 International Criminal Police Organization (INTERPOL) or other channels as agreed to by the Parties. 2. The application for provisional arrest shall contain a description of the person sought, a statement or the existence of one of the documents mentioned in paragraph 2 of Article 10, a statement of the punishment that has or can be imposed and a concise statement of the facts or the case and the location of the person. 3. The Requested Party shall promptly inform the Requesting Party of the result of the request for provisional arrest. 4. The person arrested shall be set at liberty upon the expiration of 42 (forty two) days if a request for extradition supported by the relevant documents has not been received. 5. Such release, pursuant to paragraph 4 of this Article, shall not prevent subsequent re-arrest and institution of extradition proceedings of that person if the Requested Party has subsequently received the formal request for extradition. Article 15 Decision on the Request for Extradition 1. The Requested Party shall deal with the request for extradition pursuant to the procedures provided by its national law and shall promptly communicate its decision to the Requesting Party. 2. If the Requested Party refuses the whole or any part of the request for extradition, the reason for refusal shall be notified to the Requesting Party. 12 Article 16 Surrender of the Person 1. Upon being informed that extradition has been granted, the Parties shall arrange for the time, place, and other relevant matters relating to the surrender of the person sought. The Requested Party shall inform the Requesting Party of the length of time for which the person was detained with a view to surrender. 2. If the Requesting Party has not taken over the person sought within 21 (twenty one) days after the date agreed for surrender, the Requested Party shall release that person immediately and may refuse to consider a new request by the Requesting Party for extradition of that person for the offence for which the extradition has been requested. 3. If a Party fails to surrender or take over the person sought within the agreed period for reasons beyond its control, the other Party shall be notified promptly. The Parties shall agree on a new time and place and relevant matters for the execution of the extradition subject to their national laws. In this case, the provisions of paragraph 2 of this Article shall apply. Article 17 Postponement and Temporary Surrender 1. If the person sought is being proceeded against or is serving a sentence in the Requested Party for an offence other than that for which the extradition is requested, the Requested Party may, after having made a decision to grant extradition, postpone the extradition until the conclusion of the proceedings or the completion of the sentence. The Requested Party shall inform the Requesting Party of the postponement. 2. If the postponement of the extradition may seriously impede the criminal proceedings in the Requesting Party, the Requested Party may, upon 13 request, temporarily surrender the person sought to the Requesting Party, provided that the Requested Party's on-going criminal proceedings are not hindered, and that the Requesting Party undertakes to return that person unconditionally and immediately upon conclusion of relevant proceedings. Article 18 Surrender of Property 1. If the Requesting Party so requests, the Requested Party shall, to the extent permitted by its national law, seize the proceeds and instruments of the offence and other property which may serve as evidence found in its territory or found in the possession of the person sought, and when the request for extradition is granted, shall surrender these property to the Requesting Party. 2. When the request f<?r extradition is granted, the property mentioned in paragraph 1 of this Article may nevertheless be surrendered even if the extradition cannot be carried out owing to the death, disappearance or escape of the person sought, or any other reasons. 3. The Requested Party may, for conducting any other pending criminal proceedings, postpone the surrender of the above-mentioned property until the conclusion of such proceedings, or temporarily surrender that property on the condition that the Requesting Party undertakes to return it. 4. The surrender of such property shall not prejudice any legitimate right of the Requested Party or any third party to that property. Where these rights exist, the Requesting Party shall, at the request of the Requested Party, promptly return the surrendered property without charge to the Requested Party as soon as possible after the conclusion of the proceedings. 14 Article 19 Mutual Legal Assistance Each Party shall, to the extent permitted by its laws, afford the other the widest measure of mutual assistance in criminal matters in connection with the offence for which extradition has been requested. Article 20 Transit
1. To the extent permitted by its law, transit of a person to be extradited to one Party by a third state through the territory of the other Party shall be authorized upon request submitted through diplomatic channel or directly through the Central Authorities of the Parties. Authorization for transit shall not be required when air transport is to be used and no landing is scheduled in the territory of the Party of transit. 2. If an unscheduled landing occurs in the territory of that Party, it may require the other Party to furnish a request for transit as provided in paragraph 1 of this Article. That Party may, in so far as not contrary to its national law, hold the person in custody for a period of 72 (seventy two) hours while waiting the request of transit. Article 21 Concurrent Requests 1. Where requests are received from two or more states for the extradition of the same person, either for the same offence, or for different offences, the Requested Party shall determine to which of those states the person is to be extradited and shall notify the Requesting Party of its decision. 2. In determining to which state a person is to be extradited, the Requested Party shall consider all relevant circumstances including: 15 I I (a) if the requests relate to different offences; (b) the gravity or relative seriousness of the offences; (c) the time and place of commission of each offence; (d) the respective dates of the requests; (e) the nationality of the person; (f) the ordinary place of residence of the person; (g) the possibility of subsequent extradition to another state; and (h) if the requests were made pursuant to a treaty. Article 22 Expenses Expenses arising from the procedures for extradition in the Requested Party shall be borne by that Party. Expenses of transportation and the transit expenses in connection with the surrender or taking over of the extradited person shall be borne by the Requesting Party. Article 23 International Obligations This Treaty shall not affect the rights and obligations of the Parties concerning extradition pursuant to international conventions or other arrangements to which they are parties. 16 1 1 I Article 24 Settlement of Differences Any differences arising from the interpretation or application of this Treaty shall be settled by consultation between the Parties. Article 25 Review and Amendments
1. This Treaty may be reviewed based on the agreed mechanism between the Parties.
2. This Treaty may be amended by agreement in writing between the Parties. Such amendments shall enter into force by the same procedure as applicable for the entry into force of this Treaty. Article 26 Entry into Force and Termination 1 1
1. This Treaty shall enter into force 30 (thirty) days after the last notification on I which the Parties have notified each other in writing that their respective requirements for entry into force of this Treaty have been complied with.
2. Either Party may terminate this Treaty by giving notice in writing through diplomatic channel to the other Party at any time and it shall cease to be in force 6 (six) months after the receipt of the notice to terminate. T he termination of this Treaty shall not affect the extradition requests submitted prior to the termination.
