tml RPPUBLI}T INDONPSIA NOTA KESEPAHAMAN ANTARA KEMENTERIAN PERTAHANAN REPUBLIK INDONESIA DAN KEMENTERIAN PERTAHANAN KERAJAAN SPANYOL TENTANG KEGIATAN KERJA SAMA DI BIDANG PERTAHANAN Kementerian Pertahanan Republik lndonesia dan Kementerian Pertahanan Kerajaan Spanyol, selanjutnya disebut sebagai "Para Pihak"; Mempertimbangkan pentingnya memajukan kerja sama pertahanan dalam hubungan bitateral antara kedua negara dan pentingnya kerja sama tersebut dalam pemeliharaan perdamaian dan keamanan internasional; Mengakui adanya kebutuhan untuk memperkuat hubungan persahabatan dan kerja sama teknik yang telah terjalin antara kedua negara yang didasarkan pada penghormatan penuh atas hak kedaulatan dan integritas wilayah dan prinsip- prinsip persamaan, tidak mencampuri urusan dalam negeri dan saling menguntungkan; Meneguhkan kembali komitmen internasional kedua negara terhadap prinsip- prinsip dan norma-norma hukum internasional yang telah diakui secara umum; dan Sesuai dengan hukum dan peraturan perundang-undangan yang berlaku di kedua negara. Telah mencapai kesepahaman sebagai berikut. A. TUJUAN Nota Kesepahaman ini bertujuan untuk membentuk kerangka kerja guna meningkatkan kegiatan kerja sama di bidang hubungan pertahanan dan militer antara Para Pihak dalam lingkup yang menjadi kepentingan bersama berdasarkan prinsip-prinsip saling menghormati, saling percaya dan keuntungan bersama. 2 B. BIDANG KERJA SAMA Bidang kerja sama dalam Nota Kesepahaman ini akan mencakup: Pertukaran kunjungan pejabat pada tingkat kementerian termasuk angkatan bersenjata. Pertukaran informasi atau praktek-praktek terbaik dalam bidang- bidang seperti kebijakan pertahanan, pendidikan dan pelatihan, bantuan medis, peraturan perundang-undangan militer, jasa militer dan bidang-bidang lainnya yang disepakati bersama. Pembinaan hubungan yang lebih erat antara lembaga-lembaga Angkatan Bersenjata kedua negara, dan pengembangan kerja sama dalam bidang-bidang berikut:

a. Operasipemeliharaanperdamaian;

b. Bantuan kemanusiaan dan bantuan bencana;

c. Operasi pencarian dan penyelamatan;

d. Manajemen krisis;

e. Komando, kendali, komunikasi dan sistem informasi; f. Pendidikan, pelatihan dan latihan;

g. Kegiatan lainnya yang disepakati bersama. Dukungan peran serta personil Angkatan Bersenjata masing-masing dalam berbagai kegiatan yang tepat. 5. Peningkatan kerja sama ilmu pengetahuan dan teknologi dalam bidang pertahanan melalui: a. Pertukaran informasi, pendidikan dan pelatihan, kunjungan, pertukaran personel dan proyek bersama; Penelitian dan pengembangan bersama peralatan pertahanan dan persenjataan baru, peralatan dan persenjataan elektronik, peralatan lain untuk kebutuhan khusus, serta perancangan dan produksi teknologi dari persenjataan dan peralatan yang disebutkan bagi angkatan darat, laut, dan udara. 6. Pengembangan kerja sama di bidang industri pertahanan, yang meliputi alih teknologi, penelitian bersama, produksi bersama dan pemasaran bersama 1 2 ? 4. b 3 untuk melaksanakan ketentuan-ketentuan Nota Kesepahaman ini para Pihak secara bersama-sama akan menyusun dan menentukan program kerja sama tahunan. Pengaturan untuk kunjungan resmi oleh para Menteri dan pejabat tinggi akan ditentukan secara terpisah dari program tahunan ini. C. INFORMASI RAHASIA DAN HAK KEKAYAAN INTELEKTUAL sesuai dengan peraturan perundang-undangan di negara masing-masing Para Pihak wajib memberikan perlindungan yang tepat terhadap lnformasi Rahasia, pengungkapan dan penyampaian informasi dan Hak Kekayaan lntelektual, termasuk kepemilikan dan penggunaannya secara sah, yang dipedukarkan atau dihasilkan sesuai dengan Nota Kesepahaman ini. Hal- hal yang menyangkut perlindungan dan diskibusi informasi dan Hak Kekayaan lntelektual, termasuk perlindungan hak-hak yang sah dari pihak ketiga, dengan mempertimbangkan penuh pembagian kepemilikan secara adil berdasarkan kontribusi dari masing-masing Pihak, diatur oleh perjanjian yang dibuat oleh organisasi-organisasi dari Para Pihak pada bidang-bidang kerja sama tertentu. D. KETENTUAN AKHIR 1 setiap kegiatan yang berkaitan dengan Nota Kesepahaman ini tunduk pada ketersediaan dana dari masing-masing pihak, diperuntukkan atau disediakan untuk tujuan tersebut, dan tunduk pada hukum dan ketentuan yang berlaku dari masing-masing pihak. Para Pihak dapat bersama-sama menyepakati pengaturan terpisah secara tertulis untuk pelaksanaan kegiatan kerja sama tertentu sesuai dengan Nota Kesepahaman ini. setiap masalah yang timbul dari penafsiran Nota Kesepahaman ini akan diselesaikan secara damai, melalui perundingan antara para Pihak, atau dalam hal masalah tersebut tidak dapat terselesaikan oleh Para Pihak, maka akan diselesaikan melalui saluran diplomatik. 2 3. 4. Nota Kesepahaman ini dapat diubah secara tertulis melalui persetujuan bersama Para Pihak. setiap perubahan dimaksud dinyatakan berlaku pada tanggal yang disetujui para pihak. 4 5. Nota Kesepahaman ini akan mulai berlaku pada saat penyerahan nota diplomatik di mana para pihak saling memberitahukan mengenai selesainya pemenuhan persyaratan yang ditetapkan oleh peraluran perundang-undangan masing-masing bagi berlakunya Nota Kesepahaman ini. Nota Kesepahaman ini akan tetap berlaku untuk jangka waktu 5 (lima) tahun dan secara otomatis akan diperpanjang uniuk jangka waxtu 5 (lima) tahun berikutnya kecuari sarah satu pihak men-gakhirinya dengan memberikan pemberitahuan tertulis sekurang-kuiangnya-6 (enam) bulan sebelum keinginannya untuk meigakhiri- irlota Kesepahaman ini. Masing-masing Pihak setiap saat dapat mengundurkan diri dari Nota Kesepahaman ini, namun harus menyampaikannya secara tertulis kepada Pihak lainnya setambat-tambatnya'90 (sembilan puluh) hari sebelum penghentian keikutsertaannya dalam Nota Kesepahaman ini. b 7 SEBAGAI BUKTI, yang bertandatangan di bawah ini, yang diberi kuasa oleh Pemerintah masing-masing, telah menandatangani Nota kesepahaman ini. Ditandatangani di Jakarta pada tanggal 13 Februari 2013, dalam dua rangkap, masing-masing dalam bahasa lnggris, spanyol dan lndonesia, semua nisrdrn berkekuatan hukum yang sama. Dalam hal terjadi perbedaan penafsiran, para Pihak akan merujuk pada naskah bahasa lnggris. UNTUK KEMENTERIAN PERTAHANAN REPUBLIK INDONESIA UNTUK KEMENTERIAN PERTAHANAN KERAJAAN SPANYOL I Purn Yusgiantoro Pertahanan Pedro Moren6s Eulate Menteri Pertahanan Me REPUBLIX UII}OilESIA MEMORANDO DE ENTENDIMIENTO ENTRE EL MINISTERIO DE DEFENSA DE LA REPUBLICA DE INDONESIA Y EL MINISTERIO DE DEFENSA DEL REINO DE ESPaf.tA SOBRE ACTIVIDADES DE GOOPERAC toN EN EL CAMPO DE LA DEFENSA ,(.,:r h *iffi.,' 2 MEMORANDO DE ENTENDIMIENTO ENTRE EL MINISTERIO DE DEFENSA DE LA REPUBLICA DE INDONESIA Y EL MINISTERIO DE DEFENSA DEL REINO DE ESPANA SOBRE ACTIVIDADES DE COOPERACTON EN EL CAMPO DE LA DEFENSA El Ministerio de Defensa de la Rep0blica de lndonesia y el Ministerio de Defensa del Reino de Espaha, denominadas en lo sucesivo los "Participantes"; Gonsiderando la importancia de promover la cooperaci6n de defensa en las relaciones bilaterales entre los dos paises y de su importancia para el mantenimiento de la paz y la seguridad; Reconociendo la necesidad de fortalecer las existentes relaciones de amistad y cooperaci6n t6cnica entre los dos paises basada en el pleno respeto de la soberania y Ia integridad territorial y los principios de igualdad, la no interferencia en los asuntos internos y de beneficio mutuo; Reafirmando sus compromisos internacionales a los principlos generalmente reconocidos y las normas del derecho internacional; y Conforme a las leyes vigentes y los reglamentos en los respectivos palses. Han alcanzado los siguientes acuerdos: A. OBJETIVO Este Memorando de Entendimiento (MOU) es para proporcionar un marco para mejorar las actividades de cooperacion en materia de defensa y las relaciones militares entre los participantes en dreas de inter6s mutuo, basado en los principios de respeto mutuo, confianza y beneficio mutuo. 3 B. Anras DE coopERActoN Las dreas de cooperacion en este MOU incluir6n 1 2. lntercambio de visitas de funcionarios a nivel de Ministerios, incluyendo las fuerzas de defensa. lntercambio de informacion o de mejores pr6cticas en 6reas como la politica de defensa, educaci6n y capacitaci6n, asistencia m6dica, legislaci6n militar, servicios militares y otras 6reas mutuamente acordadas. Fomentar los contactos entre las instituciones de las fuerzas armadas de ambos pafses y desarrollar la cooperacion en los 6mbitos siguientes:

a. Operaciones de mantenimiento de la paz;

b. Asistencia humanitaria y atenuaci6n de desastres;

c. Operaciones de b0squeda y salvamento;

d. Gesti6n de crisis;

e. Mando, control, comunicaciones y sistemas de informacion;

f. Educaci6n, formaci6n y ejercicios;

g. Otras 6reas mutuamente acordadas. Patrocinar la participacidn en actividades apropiadas de personal de las fuerzas armadas de los participantes. Promoci6n de la cooperaci6n en defensa de ciencia y tecnologia a trav6s de:

a. lntercambio de informaci6n, educaci6n y formaci6n, visitas, intercambio de personal y proyectos conjuntos;

b. lnvestigaci6n y Desarrollo Conjunto de nuevos equipos y armamento de defensa, equipos y armamento electr6nicos, equipos especiales, as[ como tecnologlas de disef,o y producci6n del armamento y equipos para el Ej6rcito, la Armada y la Fuerza A6rea. Desarrollar la cooperaci6n en el 6rea de ra industria de defensa, que incluye la transferencia de tecnologia, investigaci6n, producci6n conjunta y comercializaci6n conjunta. J 4. 5 b. 4 Con el fin de aplicar las disposiciones de este acuerdo, cada afro, los participantes compilariin y decidirin mutuamente sobre un programa de cooperaci6n. El r6gimen de visitas oficiales de ministros y funcionarios de alto rango se determinard al margen de este programa anual. C. INFORMAGTON CLASTFTCADA Y DERECHOS DE PROPIEDAD INTELECTUAL Conforme a la legislaci6n de sus respectivos Estados, los participantes proporcionar6n una protecci6n eficaz de la informaci6n clasificada, de la divulgaci6n y distribuci6n de informaci6n, y de los derechos de propiedad intelectual, incluyendo su propiedad y uso legal, que se transferirdn o crearan de acuerdo con este MOU. Las cuestiones de protecci6n y distribucion de informacion y derechos de propiedad intelectual - incluyendo la proteccion de los legitimos derechos de terceras partes, y teniendo plenamente en cuenta Ia porci6n equitativa de la propiedad basada en la contribuci6n de los participantes respectivos - se regulardn por los acuerdos celebrados por los distintos organismos de los participantes, en 6reas especlficas de cooperaci6n. D. DISPOSICIONESFINALES Cualquier actividad relacionada con este MOU estar6 sujeta a la disponibilidad de fondos de cada participante, - presupuestados o puestos a disposici6n para tales fines - asi como a las leyes y reglamentos respectivos del participante.

2. Los participantes determinardn mutuamente disposiciones separadas, por escrito, para la realizaci6n de actividades especificas de cooperaci6n en virtud de este MOU. 3. Cualquier asunto que surja sobre la interpretaci6n de este MOU deber6 resolverse amistosamente, a trav6s de la negociaci6n entre los participantes o, en caso de que el asunto no se resuelva por los participantes, a trav6s de canales diplomdticos. 4. Este MOU puede ser modificado por escrito, por consentimiento mutuo de los participantes. Cualquier modificacion tendrd vigencia en la fecha determinada por los participantes. 1 5 Este Mou entrar6 en vigor a la entrega de sendas Notas Diplomdticas, a trav6s de las cuales los participantes se hayan informado mutuamente sobre la finalizaci6n de los trdmites establecidos por su legislacion interna para la entrada en vigor de este MOU. Este Mou permanecerd en vigor por un periodo de 5 (cinco) aftos y se prorrogar6 automaticamente por otros 5 (cinco) afros, a menos que alguno de los participantes lo d6 por finarizado mediante notificaci6n escrita, al menos 6 (seis) meses antes de su intenci6n de finalizar este MOU. cualquier participante puede interrumpir su participacion en este MoU, en cualquier momento, pero debe esforzarse en proporcionar al otro notificaci6n por escrito, por lo menos g0 (noventa) dias antes de la prevista interrupci6n de su participaci6n en este MOU. EN TESTIMONIO DE LO CUAL, los suscribientes, debidamente autorizados por sus respectivos Gobiernos, firman el presente MOU. Firmado en Yakarta, el 13 de febrero de 2013, en dos ejemplares, cada uno en idioma ingl6s, espafrol e indonesio, siendo todos ellos igualmente aut6nticos. En caso de interpretaciones divergentes, los Participantes acudirdn al texto en ingl6s. o. 7 POR EL MINISTERIO DE DEFET'ISA DE LA REPUBLICA DE INDONESIA Yusgiantoro el de Defensa POR EL MINISTERIO DE DEFENSA DEL REINO DE ESPANA Pedro Moren6s Eulate el Ministro de Defensa tffii REPUBLIIi INDONESIA MEMORANDUM OF UNDERSTANDING BETWEEN THE MINISTRY OF DEFENCE OF THE REPUBLIC OF INDONESIA AND THE MINISTRY OF DEFENCE OF THE KINGDOM OF SPAIN ON COOPERATIVE ACTIVITIES IN THE FIELD OF DEFENCE The Ministry of Defence of the Republic of lndonesia and the Ministry of Defence of the Kingdom of Spain, hereinafter referred to as the "Participants"; Considering the importance of promoting defence co-operation in bilateral relations between the two countries and of its particular significance for the maintenance of international peace and security; Recognizing the need to strengthen the existing friendly relations and technical co-operation between the two countries based on full respect of sovereignty and territorial integrity and the principles of equality, non interference to the internal affairs and mutual benefit; Reaffirming their international commitments to the generally recognized principles and norms of the international law; and Pursuant to the prevailing laws and regulations in the respective countries. Have reached the following understandings: A. OBJECTIVE This Memorandum of Understanding (MoU) is to provide a framework for enhancing cooperative activities in the field of defence and military relations between the Participants in areas of mutual interest, based on the principles of mutual respect, trust and mutual benefit. Z B. AREAS OF COOPERATION The areas of cooperation in this MoU will include:

1. Exchange of visits of officials at ministry's level including defence forces. Exchange of information or best practices in the areas such as defense policy, education and training, medical assistance, military legislation, military services and other mutually agreed areas. Fostering contacts between the Armed Forces institutions of both countries, and developing the cooperation in the following flelds:

a. Peacekeeping operations;

b. Humanitarian assistance and disaster relief;

c. Search and rescue operations;

d. Crisis management;

e. Command, control, communications and information systems; f. Education, training and exercises;

g. Other mutually agreed areas. Sponsoring participation of personnel of each other's Armed Forces in appropriate activities. Promoting of cooperation in defence science and technology through:

a. Exchange of information, education & training, visits, exchange of personnel and joint projects;

b. Joint research and development of new defence equipment and armaments, electronic equipment and armaments, other special purpose equipment, as well as design and production technologies of the above armaments and equipment for the army, navy and air force.

6. Developing co-operation in the area of defense industry, which includes transfer of technology, joint research, joint production and joint marketing. 2 3 4. tr l l i I i i ? ln order to implement the provisions of this MoU the Participants will each year compile and mutually decide upon a programme of cooperation. The arrangements for otficial visits by Ministers and high ranking officials will be determined separately from this annual programme. C. CLASSIFIED INFORMATION AND INTELLECTUAL PROPERTY RIGHTS ln accordance with the legislation of their states the Participants shall provide efficient protection of Glassified lnformation, disclosure and distribution of information and lntellectual Property Rights, including its ownership and legal use, which are being transferred or created in accordance with this MoU. The issues of protection and distribution of information and lntellectual Property Rights including protection of a third party's legitimate rights, taking into fult consideration the equitable portion of ownership based on the contribution of the respective Participants, shall be regulated by the agreements concluded by organizations of the Participants on specific areas of co-operation. D. FINAL PROVISIONS 1 Any activities related to this MoU are subject to the availability of funds of each Participant, appropriated or othenruise made available for such purposes, and to the respective Participant's applicable laws and regulations. 2 The Participants may mutually determine separate arrangements in writing for the conduct of specific cooperative activities pursuant to this MoU. ? Any matter arising from the interpretation of this MoU is to be settled amicably, through negotiation between the Participants, or in the event that the matter is not settled by the Participants, through diplomatic channels. 4 This MoU may be modified in writing by mutual consent by the Participants. Any such modification becomes operative on the date determined by the Participants. 4 This MoU will enter into force upon delivery of diplomatic notes through which the Participants have informed each other on completion of fulfillment of the requirements set up by their domestic legislation for the entry into force of this MoU. This MoU will remain in force for a period of s (five) years and wiil automatically be extended for another s (five) years unless either Participant terminate it by giving written notification at least 6 (six) months prior to its intention to terminate this MoU. o 7 Either Participant may discontinue its participation in this Mou at any time, but should endeavor to provide written notice to the other at least 90 (ninety) days prior to its intended discontinuation of its participation in this MoU. lN wlrNESS WHEREOF, the undersigned, being dury authorized by their respective Government, have signed the present MoU. signed at Jakarta on 13th February 2013, in two copies, each in English, spanish and lndonesian languages, all text being equally authentic. ln case of divergent interpretations, the Participants will refer to the English text.
