PASAL I

DEFINISI
lstilah yang digunakan dalam Memorandum of Understanding (MoU) didefinisikan
sebagai berikut:

"Pihak Pengirim" berarti negara yang mengirim personil, aset dan peralatan ke
wilayah Pihak Penerima;

"Pihak Penerima" berarti negara di wilayah yang personil, aset dan peralatan
dari Pihak pengirim berada;
3
"Personel" berarti personel militer dan sipil yang bekerja dalam lembaga-
lembaga dan badan-badan para Pihak.

PASAL II

TUJUAN

Tujuan MoU ini adalah untuk membangun prinsip-prinsip umum dan prosedur-
prosedur kerja sama antara Para Pihak dalam bidang pertahanan.

Para Pihak wajib bekerja sama atas dasar prinsip-prinsip kesetaraan, timbal
balik dan kepentingan bersama, dan menghormati penuh kedaulatan dan
integritas wilayah masing-masing negara.

PASAL III

KOMPATIBILITAS DENGAN PERSETUJUAN-PERSETUJUAN LAINNYA
MoU ini tidak akan mempengaruhi hak dan kewajiban Para Pihak yang timbul dari
perjanjian - perjanjian internasional yang secara individual atau bersama-sama telah
dibuat dengan negara-negara lain atau organisasi internasional.

PASAL IV

OTORITAS YANG BERKOMPETEN

Otoritas yang Berkompeten bertanggung jawab atas implementasi MoU ini
adalah Kementerian Pertahanan Republik lndonesia dan Kementerian
Pertahanan Republik Serbia.
2.
Untuk tujuan pelaksanaan [t/oU ini, otoritas yang Berkompeten dari Para
Pihak dapat membuat pengaturan-pengaturan tambahan.

PASAL V

AREA KERJA SAMA
Para Pihak dapat bekerja sama dalam bidang-bidang berikut:
1.
Kebijakan Pertahanan dan Strategis;
2.
Dukungan Logistik dan Kerja Sama lndustri pertahanan;
3.
Pendidikan dan Pelatihan, dan
4.
Kerjasama lain atas dasar kepentingan bersama yang disepakati oleh para
Pihak atau Otoritas yang Berkompeten.

PASAL VI

BENTUK KERJA SAMA
Kerja Sama antara Para Pihak dapat dilakukan melalui:
1.
Kunjungan Pejabat;
2.
Dialog Pertahanan dan Strategis,
3.
Pertukaran lntelijen,
4.
Pertukaran Pengalaman dan Konsultasi;
5.
Program Pelatihan dan Pendidikan;
6.
Partisipasi dalam Konferensi, Simposium dan Seminar;
7.
Pengadaan alalalat pertahanan, transfer teknologi, bantuan teknis kerja sama
industri pertahanan, dan

Bentuk-bentuk lain dari kerja sama yang disepakati oleh para pihak atau
Otoritas yang Berkompeten.

PASAL VII

KOMITE BERSAMA
Sebuah Komite bersama dibentuk untuk secara efektif mencapai tujuan MoU
Rapat akan diketuai oleh pejabat-pejabat senior pertahanan yang benrvenang
dari kedua Pihak.

Komite Bersama wajib
Mengindentifikasi bidang-bidang kerja sama yang menjadi kepentingan
bersama;
Merekomendasikan kegiatan dan program kerja sama dalam kerangka
IvloU ini;

c. Mengkoordinasikan, memantau, dan mengendarikan peraksanaan
kegiatan dan program-program kerja sama;
d. Mereview dan mengevaluasi pelaksanaan MoU ini;
e. lVlenyampaikan laporan kepada Menteri Pertahanan masing-masing dari
kedua Pihak:

Menyelesaikan permasalahan atau perbedaan pandangan dari
implementasi MoU ini.

Komposisi anggota Komite Bersama harus disepakati bersama oleh kedua
Pihak.
Komite Bersama akan bertemu sekali dalam dua tahun atau apabila
diperlukan pada tempat dan tanggal sebagaimana yang disepakati bersama.
Komite Bersama dapat membentuk sub-komite dan ketika dianggap perlu
untuk melaksanakan kegiatan kerja sama, program, atau tugas-tugas khusus
lainnya. Sub-komite harus melaporkan kepada Komite Bersama.

PASAL VIII

PERTUKARAN INFORMASI

Pertukaran dan perlindungan informasi rahasia dibuat dengan pengaturan
terpisah.
selama pelaksanaan Mou ini. Para Pihak akan melakukan pertukaran
informasi yang bersifat tidak rahasia.

PASAL IX

BIAYA-BIAYA
Pihak tuan rumah dari pertemuan Komite Bersama akan menanggung biaya
pertemuan dan penyambutan, yang dikeluarkan dalam mengadakan
pertemuan tersebut. Setiap Delegasi Para Pihak harus menanggung biaya
perjalanan sendiri untuk menghadiri pertemuan.
Biaya-biaya lain yang timbul dalam pelaksanaan Mou ini dibuat dengan
pengaturan keuangan yang terpisah oleh kedua Pihak.

PASAL X

PERLINDUNGAN HAK KEKAYAAN INTELEKTUAL
Selama pelaksanaan MoU ini, Para Pihak dapat membuat perjanjian terpisah tentang
perlindungan hak-hak atas kekayaan intelektual.

PASAL XI

KETENTUAN UMUM
Para Personil dari Pihak Pengirim wajib untuk mematuhi hukum-hukum,
peraturan-peraturan dan prosedur-prosedur Pihak Penerima pada kegiatan
yang dilakukan dalam rangka Mou ini di wilayah pihak penerima.
Kewenangan disiplin untuk Personel pihak pengirim ada pada Komandan
mereka, atau PNS senior atau penvakilan militer diwilayah Pihak Penerima.
Untuk setiap tindak pidana yang dilakukan di wilayah pihak penerima,
Personel Pihak Pengirim akan tunduk di bawah aturan hukum pihak
Penerima.
Masing-masing Pihak menghapuskan klaim untuk kompensasi dalam kasus
kematian, cedera atau kerusakan yang mungkin terjadi pada personel atau
properti Pihak yang timbul dari tindakan atau kelalaian yang disebabkan oleh
Personel Pihak lain dalam pelaksanaan MoU ini.
Sebagai pengecualian ayat (4) pada pasar ini, kompensasi dapat diklaim
dalam hal bahwa tindakan atau kelalaian telah terjadi karena kesalahan yang
disengaja atau kelalaian. Dalam kasus seperti itu, klaim harus disebsjikan
melalui negosiasi langsung antara Para Pihak tanpa dirujuk ke Pihak ketiga
untuk penyelesaian.
Dalam kasus kematian, cedera atau kerusakan yang disebabkan kepada
pihak ketiga oleh Personel Para pihak dalam pelakslnaan Mou ini, para
Pihak harus menyepakati pembayaran ganti rugi. Jika kesepakatan tidak
dapat dicapai, kasus harus dirujuk ke pengadilan yang kompeten dari negara
di mana insiden yang mengakibatkan kerusakan terjadi.

PASAL XII

PERAWATAN MEDIS
Dalam hal kebutuhan, Pihak Penerima dapat memberikan perawatan darurat medis
dan gigi tanpa penggantian untuk Personel Pihak Pengirim pada saat berada di
wilayahnya untuk tujuan pelaksanaan MoU ini.

PASAL XIII

PENYELESAIAN PERSELISIHAN
Dalam hal terjadi sengketa mengenai penafsiran dan pelaksanaan MoU ini,
kedua Pihak akan mengadakan pembicaraan pada tingkat Komite Bersama
untuk menyelesaikan sengketa secara damai.
Dalam hal terjadi kegagalan penyelesaian pada tingkat ini, Kedua Ketua
Bersama dari Komite Bersama akan merujuk hal tersebut kepada para Pihak,
jika perlu melalui saluran resmi.

PASAL XIV

AMANDEMEN
Para Pihak dapat membuat perubahan terhadap MoU ini setiap saat dengan
persetujuan tertulis bersama. Amandemen disepakati akan berlaku menurut Pasal
XVI dari tr40u ini.

PASAL XV

PENGHENTIAN
Salah satu Pihak dapat menarik diri dari MoU ini dengan mengirimkan
pemberitahuan tertulis kepada Pihak lainnya. MoU berakhir enam bulan
setelah diterimanya pemberitahuan tertulis.
Dalam kasus MoU ini diakhiri, semua kegiatan dimulai pada periode saat
MoU masih berlaku, harus dilakukan dalam kondisi yang sama seperti yang
diterapkan pada saat kegiatan dimulai.
Dalam kasus pemutusan [t4oU ini, pengaturan dari Pasal lV, ayat 2, MoU ini
akan tetap berlaku, kecuali ditentukan lain oleh pengaturan tersebut.

PASAI. XVI
PEMBERLAKUAN DAN DURASI
MoU ini mulai berlaku pada tanggal diterimanya pemberitahuan kedua oleh
Pihak yang menginformasikan satu sama lain dari pemenuhan prosedur
internal mereka diperlukan untuk MoU mulai berlaku, sesuai dengan
undang-undang nasional mereka masing-masing.
Mou ini akan tetap berlaku untuk jangka waktu 5 (lima) tahun dan dapat
diperpanjang secara otomatis selama 5 (lima) tahun kecuali salah satu pihak
memberitahukan Pihak lainnya secara tertulis mengenai keinginannya untuk
mengakhiri MoU ini.

MEMORANDUM OF UNDERSTANDING
BETWEEN
THE GOVERNMENT OF THE REPUBLIC OF INDONESIA
AND
THE GOVERNMENT OF THE REPUBLIC OF SERBIA
ON COOPERATION IN THE FIELD OF DEFENCE
The Government of the Republic of lndonesia and the Government of the Repubiic of
Serbia (hereinafter referred to as ,,parties',),
Considering the friendly and cooperative relations existing between the two
Countries, Governments and people,
Desiring to enhance and strengthen the existing bilateral relations between the two
countries through cooperative activities in the field of defence,
Taking into account the goals and principles of the United Nations Charter to
contribute to the peace in the world,
Acting in the spirit oT.partnership and cooperation with a wish to develop good
relations in the field of defence, in order to enhance mutual esteem, confidence and
understanding,
Reco-gnizing that the strengthening cooperation in the field of defence will be
beneficialto both national defences, [a*icularly Armed Forces,
Pursuant to the prevailing laws and regulations in the respective countries,
Have agreed as follows:

ARTICLE I
DEFINITIONS
The terms used in this fvtemorandum of Understanding (MoU) are defined as follows:
1.
',sending Party" means the country that sends personnel' assets and
equipment to the territory of the Receiving Party;
2.
,,ieceiving Party" ,".nr the country in the territory of which the personnel,
assets and equipment of the sending Party are located;
3.
"personnel" meins military personnel and civilians employed within the
institutions and bodies of the Parties.
ARTICLE II
OBJECTIVE
The objective of this MoU is to establish general principles and procedures for
the cooperation between the Parties in the field of defence.
The Parties shall cooperate on the basis of the principles of equality,
reciprocity and mutual interests, and full respect of the sovereignty and
territorial integrity of the respective countries.
ARTICLE III
COMPATIBILITY WITH OTHER AGREEMENTS
This MoU shall not affect the rights and obligations of the Parties arising from
international agreements which tliey have either individually or together concluded
with other states or international organizations.
ARTICLE IV
COMPETENT AUTHORITIES
The Competent Authorities in charge of the implementation of this MoU are
the Minisiry of Defence of the Republic of lndonesia and the Ministry of
Defence of the RePublic of Serbia'
For the purpose of the implementation of this MoU, the Competent Authorities
of the Parties may conclude supplementary arrangements.

ARTICLE V
AREAS OF COOPERATION
The Parties may cooperate in the following areas
Defence and Strategic Policy;
Logistic Support and Defence lndustry Cooperation,
Education and Training, and
Other areas of mutual interest to be agreed upon by the parties or their
Competent Authorities.
ARTICLE VI
FORMS OF COOPERATION
The cooperation between the Parties may be carried out through
Official visits;
Defence and Strategic Dialogue,
lntelligence Exchange,
Exchange of experience and consultations;
Training and education programmes,
Participation in conferences, symposiums and seminars;
Procurement of defence material, transfer of technology, technical assistance
of defence industry cooperation, and
pth"er lorms of cooperation to be agreed upon by the Parties or their Competent
Authorities.
ARTICLE VII
JOINT COMMITTEE

A joint Committee shall be established to effectively achieve the purposes of
this tvtoU.
The Meeting shall be co-chaired by the appropriate senior defence officials
from both Parties.

Submit report to the respective Defence Ministers of both Parties,
Settle any difference or divergence of views on the implementation of
this MoU.

The composition of the members of the Joint Committee shall be mutually
agreed by both Parties.

The Joint Committee shall meet once in two years or as and when it deems
necessary at a place and date as mutually agreed.

The Joint Committee may establish sub-committees as and when it deems
necessary for carrying out cooperation activities, programmes, or other
specific tasks. The sub-committees shall report to the Joint Committee.
ARTICLE VIII
EXCHANGE OF INFORMATION

During the implementation of this MoU the Parties shall exchange solely
unclassified information.

The exchange and protection of classified information shall be subject to a
separate agreement,
ARTICLE IX
EXPENSES

The Party hosting the Joint Committee meeting rn its territory shall bear the
costs of meeting and local hospitality, incurred in convening such meeting,
Each Delegation of the Parties shall bear its own travel expenses in respect of
its attendance at the meetings.

Other expenses incurred in the implementation of this MoU are subject to a
separate financial arrangement to be concluded between both Parties.
ARTICLE X
PROTECTION OF INTELLECTUAL PROPERTY RIGHTS
During the implementation of this MoU, the Parties may conclude a separate
agreement on the protection of intellectual property rights.

ARTICLE XI
GENERAL PROVISIONS
The Personnel of the Sending party is obliged to comply with the laws,
regulations and procedures of the Receiving Party in course of the activities
conducted under this MoU in the territory of the Receiving party.
The disciplinary authority for the Personnel of the Sending Party is vested in
their Commander, or the senior civil servant or the military representative in
the territory of the Receiving Party.
For any criminal act committed in the territory of the Receiving party, the
Personnel of the Sending Party shall be under the criminal jurisdiction bt tfre
Receiving Party.
Each Party waives any claim to compensation in case of death, injury or
damage that might occur to the Party's Personnel or property arising from the
acts or omissions caused by the personnel of the other party during the
implementation of this MoU.
As an exception to paragraph (4) of this Article, compensations may be
claimed in case that this act or omission has occurred due to wilful misconduct
or gross negligence. ln such a case, the claims shall be settled through direct
negotiations between the Parties without being referred to a third [arty for
settlement.
ln case of death, injury or damage caused to a third party by the personnel of
the Parties while acting under this Mou, the parties-shall agree on the
payment of indemnification. lf agreement cannot be reached, the Case shall be
referred to the competent tribunals of the country in which the incident that
inflicted the damage took place.
ARTICLE XII

ln case of necessity, the Receiving Pafiy shall provide emergency medical and dental
care without reimbursement for the Personnel of the SenOing Party while on its
territory for the purpose of the implementation of this MoU.

ARTICLE XIII
SETTLEMENT OF DISPUTES

ln the event of any dispute concerning the interpretation and implementation
of the present MoU, both Parties shall hold talks at the Joint Committee level
in order to settle the dispute amicably.

ln the event of a failure of settlement at this level, both Co-Chairmen of the
Joint Committee shall refer the matter to the Parties, if necessary through
official channels.
ARTICLE XIV
AMENDMENTS
The Parties may make any amendments to this MoU at any time upon mutualwritten
consent. The agreed amendments shall enter into force according to Article 16 of this
MoU.
ARTICLE XV
TERMINATION

Either Party may withdraw from this MoU by sending a written notification to
the other Party. The ItIoU terminates six months upon the receipt of such a
written notification.

ln case this MoU is terminated, all the activities initiated in the period when
this MoU was in force shall be carried out under the same conditions that
applied when the activities were initiated.
3.
ln case of termination of this MoU the arrangements from Article 4, paragraph
2, of this MoU shall remain in force, unless otherwise stipulated by those
arrangements.
ARTICLE XVI
ENTRY INTO FORCE AND DURATION

This MoU enters into force on the date of receipt of the second notification by
which the Parties inform each other of the fulfilment of their internal procedures
necessary for the tVloU to enter into for@, in accordance with their respective

This MoU shall remain in force for a period of 5 (five) years and may be
automatically extended for another 5 (five) years unless either party noiifies
either Party in writing of its intention to terminate this fvloU.
