PENGESAHAN PERSETUJUAN ANTARA PEMERINTAH REPUBLIK INDONESIA DAN PEMERINTAH REPUBLIK BELARUS TENTANG KERJA SAMA INDUSTRI PERTAHANAN (AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND THE GOVERNMENT OF THE REPUBLIC OF BELARUS ON DEFENCE INDUSTRY COOPERATION)

TUJUAN
Tujuan dari Persetujuan ini adalah untuk membentuk kerangka kerja dalam rangka
meningkatkan hubungan industri pertahanan bilateral kedua negara.

LINGKUP KERJA SAMA
Lingkup Persetujuan ini dapat meliputi:
Peningkatan kerja sama antara industri-industri pertahanan kedua negara
dalam berbagai bidang yang menjadi kepentingan bersama, termasuk alih
teknologi, pengembangan bersama dan produksi bersama, pembekalan,
pemeliharaan dan perbaikan antara lain:
a. Persenjataan dan peralatan angkatan udara;
b. Persenjataan dan peralatan pertahanan udara;
c. Persenjataan dan peralatan angkatan darat;
d. Peralatan dan persenjataan elektronik, termasuk sistem senjata kendali
dan komando otomatis, komunikasi, transfer data, pengintaian dan
sistem peperangan elektronik.
e. Perangkat optis, laser dan peralatan untuk kebutuhan khusus.
2. Peningkatan kerja sama dalam ilmu dan teknologi pertahanan melalui
a. Pertukaran informasi dan personel, pendidikan dan pelatihan, dan saling
kunjung.
b. Realisasi proyek bersama;
c. Penelitian dan pengembangan bersama peralatan pertahanan dan
persenjataan baru, peralatan dan persenjataan elektronik, peralatan lain
untuk kebutuhan khusus, serta perancangan dan produksiteknologi dari

persenjataan dan peralatan yang disebutkan bagi angkatan udara,
pertahanan udara dan angkatan darat.
3. Peningkatan dukungan produk dan jasa serta proyek-proyek bilateral yang
berkaitan dengan peralatan dan komponen pertahanan.
4. Proyek bersama dalam bidang rekonstruksi, modernisasi dan konversi
fasilitas pembuatan produk-produk yang berorientasi militer.
5. Peningkatan bentuk-bentuk kerja sama industri pertahanan lainnya yang
dapat disepakati oleh Para Pihak.

PENGATU RAN PELAKSANAAN
Badan-badan yang benruenang dari Para Pihak dapat membentuk
pengaturan pelaksanaan tertentu, berkaitan dengan aspek-aspek spesifik dan
teknis kerja sama sebagaimana disebutkan dalam Pasal 2 dalam kerangka
Persetujuan ini.
2. Para Pihak bersama-sama menentukan bahwa setiap permasalahan hak
kekayaan intelektual yang timbul dalam pelaksanaan Persetujuan ini akan
diatur dalam pengaturan yang terpisah.
3. Untuk melaksanakan Persetujuan ini Para Pihak akan membentuk Komite
lndonesia - Belarus yang bertanggung jawab untuk mempersiapkan rencana,
program atau kegiatan-kegiatan kerja sama dan merekomendasikan bentuk-
bentuk dan bidang-bidang kerja sama yang baru.

OTORITAS YANG DITUNJUK
Para Pihak menunjuk otoritas berikut ini yang bertanggung jawab atas
pelaksanaan ketentuan-ketentuan dari Persetujuan ini:
Untuk Pemerintah Republik lndonesia - Kementerian Pertahanan Republik
Indonesia;
Untuk Pemerintah Republik Belarus - Komite lndustri Militer Negara Republik
Belarus, Kementerian Pertahanan Republik Belarus.

KERAHASIAAN
Para Pihak wajib memberikan pengamanan untuk setiap informasi yang
diperoleh dalam kerangka Persetujuan ini sesuai dengan hukum nasional
masing-masing. Penyingkapan atau pelepasan informasi oleh salah satu
Pihak kepada pihak ketiga, dan pengalihan secara langsung maupun tidak
langsung, hanya diperbolehkan dengan persetujuan tertulis sebelumnya dari
Pihak yang menyediakan informasi.
2. Tidak satupun dari Para Pihak diijinkan untuk mengalihkan atau menjual
peralatan, persenjataan, produk militer termasuk teknologi terkait dan
informasi yang diperoleh dari dalam kerangka Persetujuan ini, kepada orang,
badan hukum atau badan negara dari pihak ketiga tanpa persetujuan tertulis
antara Para Pihak.
lnformasi yang diterima dari salah satu Pihak dalam pelaksanaan kerja sama
tidak boleh digunakan untuk merugikan kepentingan Pihak lainnya.

Badan-badan yang benrenang dari Para pihak menyadari rahasia komersial
yang berkaitan dengan bidang kerja sama dan akan merumuskan pengaturan
yang diperlukan untuk melindungi dan mempergunakan rahasia tersebut
untuk keuntungan bersama.

PENYELESAIAN PERSELISIHAN
Setiap perselisihan yang timbul dari atau berkaitan dengan pelaksanaan atau
penerapan dari Persetujuan ini akan diselesaikan secara damai baik melalui
negosiasi maupun saluran diplomatik.

PERUBAHAN
Persetujuan ini dapat diubah setiap saat atas persetujuan bersama secara tertulis
antara Para Pihak. Perubahan tersebut mulai berlaku pada tanggal yang
disepakati oleh Para Pihak.

SAAT MULAI BERLAKU, JANGKA WAKTU DAN PENGAKHIRAN Persetujuan ini mulai berlaku pada tanggal penerimaan nota diplomatik terakhir di mana Para Pihak saling memberitahukan mengenai selesainya pemenuhan persyaratan yang ditetapkan oleh peraturan perundang-undangan masing-masing bagi berlakunya Persetujuan ini. Persetujuan ini berlaku untuk jangka waktu 5 (lima) tahun dan secara otomatis akan diperpanjang untuk periode 5 (lima) tahunan berikutnya, kecuali salah satu Pihak menyampaikan pemberitahuan tertulis mengenai keinginannya untuk mengakhiri Persetujuan ini sekurang- kurangnya 6 (enam) bulan sebelum kehendak untuk mengakhiri Persetujuan ini. 6 SEBAGAI BUKTI, yang bertandatangan di bawah ini, yang diberi kuasa oleh Para Pihak, telah menandatangani Persetujuan ini. DIBUAT di Jakarta, pada hari ke-19 Maret 2013, dalam dua rangkap asli dalam bahasa Indonesia, Rusia dan lnggris, semua naskah berkekuatan hukum yang sama. Dalam hal terjadi perbedaan penafsiran ketentuan-ketentuan dalam Persetujuan ini, naskah dalam bahasa lnggris yang akan berlaku. ARTICLE 2 SCOPE OF COOPERATION The scope of this Agreement may include: Promotion of cooperation between the defence industries of the two countries in various areas of mutual interest, including transfer of technology, joint development and joint production, supply, maintenance and repair among others of:

a. Air force armaments and equipment;

b. Air defence armaments and equipment;

c. Army armaments and equipment;

d. Electronic equipment and armaments, including automated command and control weapons systems, communications, data transfer, reconnaissance and electronic warfare systems;

e. Optical devices, lasers and special purpose equipment.

2. Promotion of cooperation in defence science and technology through

a. Exchange of information and personnel, education & training, mutual visits;

b. Realization of joint projects;

c. Joint research and development of new defence equipment and armaments, electronic equipment and armaments, other special I i : 3 purpose equipment, as well as design and production technologies of the above armaments and equipment for the air force, air defence and army. 3 Promotion of areas of product support and services as well as bilateral projects relating to defence equipment and components. 4 Joint project on reconstruction, modernization and conversion of facilities manufacturing military-oriented prod ucts. 5 Promotion of any other areas of defence industry cooperation as may be agreed by the Parties. ARTICLE 3 IMPLEMENTING ARRANGEMENTS 1 The authorized bodies of the Parties may conclude particular implementing arrangements, pertaining to specific and technical aspects of aforementioned in Article 2 cooperation within the framework of this Agreement. 2 The Parties mutually determine that any intellectual property issues arising under the implementation of this Agreement will be regulated under separate arrangements.

3. To implement this Agreement the Parties will establish an lndonesia-Betarus Committee responsible for preparing plans, programs or activities of cooperation and recommending its new forms and areas. 4 ARTICLE 4 DESIGNATED AUTHORITIES The Parties designate the following authorities responsible for the implementation of provisions of this Agreement: For the Government of the Republic of lndonesia - Ministry of Defence of the Republic of lndonesia; For the Government of the Republic of Belarus - State tt/lilitary lndustrial Committee of the Republic of Belarus, Ministry of Defence of the Republic of Belarus. ARTICLE 5 CONFIDENTIALITY The Parties shall provide security for any information received within the framework of the Agreement in accordance with their respective national laws. Disclosure or release of information by one of the Parties to any third party, and transfer directly or indirectly, is allowed only at the prior written consent of the Party providing the information. Neither of the Parties is authorized to transfer or sell military equipment, armaments, products including related technologies and information received within the framework of this Agreement, to persons, legal entities or state bodies of the third party without written consent between the Parties.

3. lnformation received from one of the Parties in the course of cooperation may not be used to harm interests of the other Party. I 2 E 4 The authorized bodies of the Parties observe the commercial secrets related to the sphere of cooperation and will formulate necessary arrangements to protect and use such secrets for mutual benefits. ARTICLE 6 SETTI.EMENT OF DISPUTES Any dispute arising from or in connection with the implementation or application of this Agreement shall be settled amicably through either negotiation or diptomatic channels. ARTICLE 7 AMENDMENT This Agreement may be amended at any time by mutual written agreement between the Parties. Such amendment shall come into force on the date agreed by the Parties. ARTICLE 8 ENTRY INTO FORCE, DURATION AND TERMINATION fhis Agreement shall enter into force on the date of receipt of the latest diplomatic notes through which the Parties have informed each other on completion of fulfilment of the requirements set up by their domestic legislation for the entry into force of this Agreement. This Agreement is valid for 5 (five) years and shal be automatically extended for the next 5 (five) year periods unless one of the Parties notifies in writing about its intention to terminate the Agreement not later than 6 (six) months prior to its intention to terminate this Agreement.
