PASAL 3

PENGATURAN PELAKSANAAN
Dengan memperhatikan ruang lingkup kerje sarna berdasarkan Pasal ? dari
Persetujuan irti Para Pihak dapat melaksanakan bentuk-bentuk kerja sarna
sebagar berikut:
-
kunjungan resrni delegasi di berhagai tingkat;
-
partisipasi dalam latihan rniliter atas undangen atau partisipasi sebagai
pengamat;
-
kunjungan kerja pakar kemiliteran;
-
partlsipasi dalam kegiatan-kegiatan seperti kursus teori dan praktik,
serninar dan konferensi atas undangan ciari Para Pihak;
-
pendidikan dan pelatihan dari personit pertahanan dan militer;
-
panggilan sandar untul< kapal perang dan kunjungan penerbangan
nriliter;
-
kunjungan para ahli dalam pelaksanaan kegiatan bersama di lingkungan
militer;
-
pelaksanaan acara budaya dan olahraga bersama;
-
bentuk lain dari kegiatan kerja sama pertahanan dengan persetujuan
bersama Para Pihak.
Untuk tujuan pelaksanaan bentuk-bentuk kerja sama tersebut pengaturan
tertulis yang terpisah harus dibuat oleh Para Pihak.

PASAL 4

OTORITAS YANG BERWEWENANG

Otoritas yang benruewenan.q yang dipercayakan dalam pelaksanaan
Persetujuan ini adalah:
a. Untuk pihak lndonesia: Kernenterian Pertahanan Republik lndonesia
b
untuk pihak Rusia: Kementerian Pefiahanan Federasr Rusia;
Apabila clianggap perlu, dapat ciiL,entuk kelampok kerja berdasarkan
Persetujuan ini, oleh otoritas yang berwewenang dari Kedua Belah Fihak.
Apabila salah satu Fihak nrengubah Otoritas Pelaksana yang ditunjuk,
perubahan tersebut harus diinformasikan kepada Pihak lainnya melalui
saluran diplomatik.
Dalam rangka untuk meninjau pelaksanaan Pasal 2 dan Pasal 3 dari
Persetujuan i;ri, Otoritas yang benruewenang akan mengadakan pertemuan
reguler atau setiap saat apahila diperlukan.

FENGATUF.AN KEUANGAN
$etiap Pihak akan menanggung hiaya sendiri terkait dengan keikutsertaannya
rJalam Persetujuan ini, kecuall disetujui lain oteh Para Pihak,

PASAL 6

HAK KEKAYAAN INTELEKTUAL
Para Pihak mengakui bahwa selama pelaksanaan Persetujuan ini mungkin
ada karya cipta, penggunaan danlatau pengalihan hasil dari kegiatan
intelektual danlatau kekayaan intelektual rnilik Negara Para Pihak dan/atau
perorangan atau badan hukum.
$esuai dengan peraturan perundang-undangan nasional Para Pihak termasuk
traktat internasional lainnya di mana Republik lndonesia dan Federasi Rusia
berpartisipasi, Para Pihak harus mengambil langkah-langkah yang diperlukan
untuk menjamin perlindungan hukum dari hasil kegiatan intelektual dan/atau
perli ndungan kekayaan intelektual.
Tataran pendistribusian dari hak sebagai hasil kegiatan intelektual yang
diciptakan dalam pelaksanaan Persetujuan ini, perlindungan hukum dan
penggunaannya harus diatur sesuai dengan Persetujuan antara Pemerintah
Republik lndonesia dan Pemerintah Federasi Rusia Tentang Perlindungan
Bersama Atas Hak-Hak Hasil Aktifitas Intelektual yang Diterapkan dan
Diperoleh dalem Rangka Kerjasama Bilateral Teknik Militer yang
ditandatangani di hrloscow, 1 Desember 2006. dan apabila diperlukan Fara
Pihak dapat rnembuat pengaturan tertulis yang terpisah atas dasar
kesepakatan antara Para Pihak.
Perlindungan dan penggunaan kekayaan intelektual yang diperoleh,
digunakan dan/atau dialihkan dalam pelaksanaan Persetujuan ini harus diatur
sesuai dengan Persetujuan antara Pemerintah Republik lndonesia dan
Pemerintah Federasi Rusia Tentang Perlindungan Bersarna Atas Hak-Hak
Hasil Aktifitas lntelektual yang Diterapkan dan Diperoteh dalam Rangka
Kerjasama Bitateral Teknik Militer yang ditandatangani di Moscow. 1

Desember 2006. dan apabila diperlukan Para Pihak dapat membuat
pengaturan tertuli$ yang terpisah atas dasar kesepakatan antara Para Pihak.
Setiap hasil liegiatan intetel<tual daniatau kei<ayaan intelektual yang timbul dari
penelitian bersama atau kegiatan bersarna dalam pelaksanaan Persetujuan ini
dapat dimiliki bersama dan dilepaskan $ecara lqasus per kasus melalui
pengatulran tertulis yang terpisan.

PASAL 7

KERAHASIAAN I I'iFORMASI
Setiap informasi yang dipertukari<an berdasarkan Persetujuan ini harus
digunakan secara eksklusif untuk tujuan Persetujuan ini dan tidak dapat
dralihkan, dibuka atau disiarkan, baik secara [angsung maupun tidak langsung,
sementara atau permanen, kepada pihak ketiga, baik orang maupun bafian
hukum, tanpa persetujuan tertrrlis terlebih dahulu dari Pihak asal,
lnformasi yang diperoleh r"rleh satu Pihak dalam kerangka kerjasama tidak
boleh digunakan untuk efek yang merugikan Pihak lain.
Para Pihak harus menentukan sertCiri bata$-batas untuk distribusi informasr
yans dialihkan berdasarkan Persetujuan ini atau yang dihasillran dari
pelaksanaannya, Penandaan yans c{ite;'apkan pada pembawa data dan
informasi tersebut adalah sebagai berikui.

4. Pihak yang telah memperoleh informasi tersebut harus menjamin penggunaan
dan perlindungannya sesuai dengen pe;'undanE-undangan dan peraturan
nasional masing-masing Pihak terkait dcngan penanganannya.
Para Pihak harus saling memberi tahu sebelumnya tentang keharusan
menjaga kerahasiaan fakta kerja sama atau data iain yang terkait dengan
kerja sama berdasarkan Persetujuan ini. Keharusan tersebut harus diatur
dalam pengaturan tertulls tamhahan antara Para Pihak.
Tataran pertukaran, persyaratan dan langkah-langkah perlindungan informasi
rahasia ,Jari Para Pihak selama pelaKsanaan dan setelah pengakhiran
Persetujuan ini harus ditentukan dalam peraturan terpisah.

PASAL 8

BANTUAI-I MEDIS DARURAT
1 Apabila diperlukan, Pihak Penerima harus memberikan bantuan medis darurat
kepada perwakilan dari Pihak pengirinr rJalam pelaksanaan kegiatan kerja sama
berdasarkan Persetujuan ini,
2. Bantuan medis harus diberikan dalarn fasilitas medis militer atau sipil di Pihak
Penerima.
3. Kecuali disepakati lain oleh Para Pihak, Pihak pengirim harus menanggung
biaya bantuan medis dimaksr-rd,

PASAL 9

PEHYELESAIAN SENGKETA

Setiap sengketa antara Para Pihak yans tinrhul dari penafsiran atau pelaksanaan
persetujuan ini harus diselesaikan rnelalui konsultasi atau negosiasi bersarna Para
Pihak dan/atau melalui saiuran diplomatik

AMANDEMIN
Dengan persetujuan tertulis dari para pihak, perubahan dapat dibuat terhadap
Persetujuan ini. Perubahan tersebut mulai berlaku sesuai dengan Pasal 11 dari
Persetujuan ini.

PASAL 11

PEMBERLAKUAN DAN PENGAKHIRAN
Persetujuan ini mulai berlaku pada tanggal pt mberitahuan tertulis terakhir dari
pernenuhan pro$edur internal yang oleh Para Pihak.
Persetujuan ini akan tetap berlaku untuk jangka waktu 5 {lima) tahun dan akan
diperpanjang $ecara otomatis untuk jangka waktu 5 (limai tahun berikutnya.
Salah satu Pihak dapat mengakhiri Persetujuan ini dengan menyampaikan
pemberitahuan tefiulis paling lama 6 (enarn) bulan sebelurn tanggal
pengakhiran yang diinginkan.
Pengakhiran Persetujuan ini tidak akan mempengaruhi pengaturan tertulis
yang dibuat oleh Para Pihak berdasarkan Persetujuan ini kecuali disetujui lain
oleh Para Pihak

ketentuan Pasal 7 Persetujuan ini kecuali disetujui lain oleh kedua belah
Pihak.
Ketentuan-ketentuan dalam Persetujuan ini tidak akan mempengaruhi haK dan
kei,uajiban Fara Pihak yang berkaitan dengan traktat internasional lainnya
dimana Republik indsnesra dan Federasi Rusia herpailisipasr.

Sesiring to enhance and strengthen the *xisting bilateral relations between the two
Parties through cooperative activities in the field of clefence based on the principles
of equality, mutual benefit, full respect of sovereignty and territorial integrity and
non-interference in internal affairs;
Havlng a purpose of strengthening connections between the Armed Forces of the
Republic of lndonesia and the Arri'red Forces of the Hussian Federation;
Noting that the strengthening of defence cooperation will contribute to the mutually
beneficial relations of both Parties national defences;

ARTICLE 1
PURPO$E
The purpose of this Agreement is to estab,lisl'r a tramework for cooperation in the
field of defence between the Parties, irr arcord,srrce with universally recognired
principles anri norms of international laur and international treaties which
participants are the Repubtic of lndr:lresia and the Russien Federation il$ well as in
accr"rrdance with the national regislation of the Parties.
ARTICLE ?
SCOPE OF COOPTRATION
The scope of cooperation of this Agreemsr':t rrray irx:iude
1, fstablishing regular bilateral dialogues and consulltations on secur"ity issues of
cornmon cCIncern; such as CIn political-military aspects, mutual confidence-
building, international security issues, and counter-terrorism.

2. Exchanging information and experiences on issues of common concerns; such
a$ in peace-building activities and psacekeeping CIperations under the auspices
of the United Nations Organizations,
3 Promoting human resources development of defence institutions and armed
forces of both Parties tnrough education, training, exchange of visits, provisions
of educational equipment and other related activities"
4. Deveioprng relations anc cooperation netween the Armed Forces of both Parties
as mutuaily agreed upon.
5. Participating in the development of cooperation in accordance with the national
legislation of the Parties in the following areas:
a" Science and technology on the field of defence through exchange of
oersonnel, visrts. trainings, and exchange of information, as well as
developing muiti"rally agreed joint prc'jects,
b. Defence industry, which includes transfer of technology, joint research, joint
production and joint marketing,

ARTICLE 3
IMPLEMENTING ARIIANGHMENTS
With due regard to the scope of cooper'stion under Arlicle 2 of this Agreement the
Partles may conduct the following forms of cooperation, such as through.
- official visits of the delegations at various levels,
- participation in military exercises on invitation of the Parties or pa.rlicipation in
them as obseruers;
- working visits of military experts;
- participation in activities such as theoretic and practical courses, seminars
and conferences upon invitation of tl're Farties;

- education and tralning of rlefence and military personnel;
- port calls of luarships and visits of military aviation;
- visits of specialists for irnplementation of common activities in nnilitary sphere,
- conduct of joint cultural and sports events;
- other forms of defence cooperaticn activities by mutual consent of the
Farties.
2. For the purpose of implementation of lhese forms of cooperation separate,
written arrangements shall be conciuded between the Farties.
ARTICLE 4
COMPETENT AUTHORffI ES
1. The competent authorities entrusted with the implementation of this Agreernent
are:
a. For the Russian side: the Ministry of Defence of the Russian Federation;
b. For the lndonesian siCe: the Ministry of Defence of the Repubtic of lndonesia
2. As deemed neces$ary, working group$ may be established under this
Agreement, by the competent authorities of both Parties.
3. Where either Party changes its designated lmplementing Authorities, it shatl
infcrrm the other Party of such change through diplomatic channels.
4. ln order to review the implementation of Arlicle 2 and Article 3 of this Agreement,
the Competent Authorities shail holcl regular meetings or at any time deemed
neces$ary.

1. Each Party will bear its own costs associated with its panicipation in this
Agreement, unless agreed othenruise by the Partiss,
2. $eparate financial arrangements may he concluded hetween the Parties for
specific activities
3, Carrying out of activities under this Agreement shall be subject to the availability
of funds of the Parties.
ARTICLE 6
INTELLECTUAL FROPTRTY RIGHTS
1. The Parties recognize that during the implementation of this Agreement there
may be a creation, use and/or transfer of results of inteilectual activity andlor
intellectual propefiy belonging to the Parties' States and/or their natural or
juridical person$.
2. ln acccrdance with the national legislation of the Farties as well as with other
international treaties where the Republic of lndonesis and the Russian Federation
are participants, the Parties shall take necessary measures to as$ure iegal
protection of results of intellectual activity and/or protection of intellectual
property.
3. The order of distributions of rights for the results of intellectual activity created in
course of implementation of this Agreement, their legal protection and use, shall
be arranged in accordance lvith the Agreement between the Government of the
Republic of lndonesia and the Governnnent of the Russian Federation on mutual
protection of rights to the results of intellectual activity applied and obtained in
the course of bilateral military-technical cocperation signed in Moscow on 1
December 2006, and when necessary Parties rnay conclude separate written
arrangements upon agreement between the Parties.

4. The protection and use of intellectual property obtained, used and/or transferred
in caurse of implementation of this Agreement, shall be arranged in accordance
with the Agreement between the Governrnent of the Rspublie of lndonesia and
the Government of the Russian Federation on mutual protection of rights to the
results of intellectual activity applied and obtained in the cour$e of bilateral
military-technical cooperation signed in fi,lossow on 1 December 2006, and when
necessary Parties may conclude separate written arrangernents upon agreement
between the Parties.
5. Arty resulls of intellectual activity and/or intellectual property arising out of jornt
research or joint activity under the implernentation of this Agreennent may he
jointly owned and disposed on case by case basis through a separate written
arrangement.
ARTICLE 7
NON-DISCLOSURE OF IN FORMATION
'1. Any information exchangeo under the framelrcrk of this Agreernent shall be
used exslusively for the purpose of this Agi'eernent and shall not be transferred,
disclosed or released, either directly or indirectly, on temporary or permanent
basis. to third parties, whether persons cr entities, without the prior written
consent of the originating Party.
2. The information obtained by a Farty within the framework of cooperation shall
not be used to the detrimentat effect nf the other Party
3. The Parties shall determine themselves tire linrits to distributions of the
information transferred pursuant to this irgreenrent or resulting from its
implementation. iltlarking applied to data carrier of sucir information shall be as

4" The Party that has obtained such information shall en$ure its u$e and
protectlon in accordence with each Party's national legistation and regulations
retated tn its handling.
5, The Palties shall inform each other in advance on the necessity to keep secret
of the fact of cooperation or other drita reiated to cooperation under this
Agreernent. Such necessity shall be specifieo in additional written arrangernerrt
between the Pafiies.
6. The order of exclrange, the terms and protection rneasures of classified
information of the Parties during the implementation ancl after the termination of
this Agreement shall be determined by a separate Agreement.
ARTICLE 8
EMERGENCY h.|EDICAL ASSISTANCE

lf necessary, the host Party shall provide emergency rnedical assistance to the
repre$entatives of the sending Party in the course of cooperation activities
under the present Agreement.
2. Such medical assistance shall be rende;^ed in military or civillan medical
facilities of the host Party"
3. Unless otherwise agreed by the Parties, the sending Party shall cover the
expen$es of such medical assistance.
ARTICLH S
SEfiLEMENT OF DISFUTES

Any disputes between tl:e Partieu arising on the interpretaticn or implementation of
this Agreement shall be settled thrtrugh mutiral consultation or negotiation of the
Parties and/or through diplornatic channels.
ARTICLf; 1O
AMENDMENTS
By mutual written consent of the Fertres, amendment can be made to the present
/\greement, The amendment shall oonre into force in accordance with Article '1 1 of
the present Agreement
ARTICLE 11
ENTRY INTO FORCE AND TERMINATION
1. This Agreement shall enter into 'iorce on the date of the last written notification of
the fulfillment of neces$ary internal state procedures by the Parties.
2. This Agreement shall remain in force for a period of 5 (five) years and shall
automatically lre extended for subsequent periuds of 5 (five) year$. Either Party
rnay terminate this Agreement by giving written notifieation at least 6 (six)
months prior to the date of its intended termination,
3. Termination of the present Agreement shall not affect the written arrangements
commenced by the Parties under this Agreement unless othenvlse agreed by
the Parties.
4. Termination of this Agreement shall not affect the validity of the provisions of
Afiicle 7 of the present Agreernento"rnless otherwise agreed by both Parties,
5. The provisions of the present Agreernent shall not affect the rights and
obligatrons of the Parlies under other rnterrrational treaties in which the Republic

of lndonesia anC the Russian Federation are participants

respective Governments, have signed this Agreement.
