Recommends to all Contracting States that they ratify most urgently the amendment to Article 50 (a) of the Convention; and 2. Directs the Secretary General to bring this resolution to the attention of Contracting States as soon as possible. ATTACHMENT C to State letter LE 3/1.20, LB 3/1.21 - 17/002 ADMINISTRATIVE PACKAGE FOR RATIFICATION OF THE PROTOCOL AMENDING ARTICLE 50 (A) OF THE CONVENTION ON INTERNATIONAL CIVIL AVIATION (2016) 1) Full Name of Instrument: Protocol Relating to an Amendment to the Convention on International Civil Aviation [Article 50(a)], signed at Montreal on 6 October 2016. (Doc 10077) 2) History: Assembly - 39th Session, Montreal, 27 September to 6 October 2016 3) Summary: This fifth amendment to Article 50 (a) provides for an increase in the size of the Council from thirty-six members to forty members. The original Convention called for a Council composed of twenty-one members. This was subsequently amended, in 1961, to provide for twenty-seven members, in 1971, for thirty members, in 1974, for thirty-three members, and in 1990, for thirty-six members. 4) Main reasons for ratification: In view of the increase in the membership of the International Civil Aviation Organization (IC AO) and the expansion and increasing importance of international air transport for the national economies in many countries, an enlarged membership of the Council ensures a better balance by means of an increased representation of Contracting States. Moreover, pursuant to ICAO Assembly Resolution A39-5, Contracting States are recommended to ratify most urgently this amendment to Article 50 (a) of the Convention. 5) Entry into force: The Protocol shall come into force in respect of the States which have ratified it on the date on which the one hundred and twenty-eighth instrument of ratification is so deposited. With respect to any Contracting State ratifying the Protocol after the date aforesaid, the Protocol shall come into force upon deposit of its instrument of ratification with ICAO. 6) Information on Instrument of Ratification An instrument of ratification in original form is required for deposit, in any of the ICAO working languages (English, Arabic, Chinese, French, Russian or Spanish). PROTOCOL RELATING TO AN AMENDMENT TO ARTICLE 50(fl) OF THE CONVENTION ON INTERNATIONAL CIVIL AVIATION Signed at Montreal on 6 October 2016 THE ASSEMBLY OF THE INTERNATIONAL CIVIL AVIATION ORGANIZATION HAVING MET in its Thirty-ninth Session at Montreal on 1 October 2016, HAVING NOTED that it is the desire of a large number of Contracting States to enlarge the membership of the Council in order to ensure better balance by means of an increased representation of Contracting States, HAVING CONSIDERED it appropriate to increase the membership of that body from thirty-six to forty, HAVING CONSIDERED it necessary to amend, for the purpose aforesaid, the Convention on International Civil Aviation done at Chicago on the seventh day of December 1944,
1. APPROVES, in accordance with the provisions of Article 94(a) of the Convention aforesaid, the following proposed amendment to the said Convention: "In Article 50(a) of the Convention the second sentence shall be amended by replacing 'thirty-six' by 'forty'.";
2. SPECIFIES, pursuant to the provisions of the said Article 94(a) of the said Convention, one hundred and twenty-eight as the number of Contracting States upon whose ratification the proposed amendment aforesaid shall come into force;
3. RESOLVES that the Secretary General of the International Civil Aviation Organization draw up a Protocol, in the English, Arabic, Chinese, French, Russian and Spanish languages, each of which shall be of equal authenticity, embodying the amendment above-mentioned and the matter hereinafter appearing: a) The Protocol shall be signed by the President of the Assembly and its Secretary General. b) The Protocol shall be open to ratification by any State which has ratified or adhered to the said Convention on Intemational Civil Aviation. c) The instruments of ratification shall be deposited with the International Civil Aviation Organization. d) The Protocol shall come into force in respect of the States which have ratified it on the date on which the one hundred and twenty-eighth instrument of ratification is so deposited. e) The Secretary General shall immediately notify all Contracting States of the date of deposit of each ratification of the Protocol. f) The Secretary General shall immediately notify all Contracting States to the said Convention of the date on which the Protocol comes into force. g) With respect to any Contracting State ratifying the Protocol after the date aforesaid, the Protocol shall come into force upon deposit of its instrument of ratification with the International Civil Aviation Organization. CONSEQUENTLY, pursuant to the aforesaid action of the Assembly, This Protocol has been drawn up by the Secretary General of the Organization. IN WITNESS WHEREOF, the President and the Secretary General of the aforesaid Thirty-ninth Session of the Assembly of the International Civil Aviation Organization, being authorized thereto by the Assembly, sign this Protocol. DONE at Montreal on the sixth day of October of the year two thousand and sixteen, in a single document in the English, Arabic, Chinese, French, Russian and Spanish languages, each text being equally authentic. 1. APPROUVE, en vertu des dispositions de I'alinea a) de Particle 94 de la Convention precitee, le projet suivant d'amendement de ladite Convention : « Amender la deuxieme phrase de Talinea a) de Particle 50 de la Convention en rempla9ant les mots "trente-six" par "quarante". » ;
2. FIXE a cent vingt-huit le nombre d'Etats contractants dont la ratification est necessaire a P entree en vigueur de Pamendement propose, conformement aux dispositions de Palinea a) de Particle 94 de ladite Convention;
3. DECIDE que le Secretaire general de POrganisation de Paviation civile intemationale etablira dans les langues fran9aise, anglaise, arabe, chinoise, espagnole et msse, chacune faisant egalement foi, un protocole concemant Pamendement precite et comprenant les dispositions ci-dessous: a) Le Protocole sera signe par le President et par le Secretaire general de PAssemblee. b) II sera soumis a la ratification de tout Etat qui a ratifie la Convention relative a Paviation civile intemationale ou y a adhere. c) Les instruments de ratification seront deposes aupres de I'Organisation de I'aviation civile intemationaie. d) Le Protocoie entrera en vigueur le jour du depot du cent vingt-huitieme instrument de ratification a Tegard des Etats qui I'auront ratifie. e) Le Secretaire general notifiera immediatement a tous les Etats contractants la date du depot de chaque instrument de ratification du Protocoie. f) Le Secretaire general notifiera immediatement a tous les Etats contractants a ladite Convention la date a laquelle ledit Protocoie entrera en vigueur. g) Le Protocoie entrera en vigueur, a I'egard de tout Etat contractant qui Taura ratifie apres la date precit^e, des que cet Etat aura depose son instrument de ratification aupres de I'Organisation de I'aviation civile intemationaie. EN CONSEQUENCE, conformement a la decision ci-dessus de I'Assemblee, Le present Protocoie a ete etabli par le Secretaire general de I'Organisation. PROTOCOLO RELATIVO A UNA ENMIENDA DEL ARTICULO 50 A) DEL CONVENIO SOBRE AVIACION CIVIL INTERNACIONAL Firmado en Montreal, el 6 de octubre de 2016 LA ASAMBLEA DE LA ORGANIZACION DE AVIACION CIVIL INTERNACIONAL HABIENDOSE REUNIDO en su trigesimo noveno periodo de sesiones en Montreal, el 1 de octubre de 2016, HABIENDO TOMADO NOTA del deseo de gran niimero de Estados contratantes de aumentar el numero de miembros del Consejo a fin de garantizar un mejor equilibrio por medio de una mayor representacion de Estados contratantes, HABIENDO CONSIDERADO oportuno elevar de treinta y seis a cuarenta el numero de miembros de ese organo, HABIENDO CONSIDERADO necesario enmendar, a los fines precitados, el Convenio sobre Aviacidn Civil Intemacional hecho en Chicago el dia siete de diciembre de 1944,
1. APRUEBA, de conformidad con lo dispuesto en el parrafo a) del Articulo 94 del mencionado Convenio, la siguiente propuesta de enmienda del mismo: "Que en el parrafo a) del Articulo 50 del Convenio se enmiende la segunda oracion sustituyendo 'treinta y seis' por 'cuarenta'.";
2. FIJA, de acuerdo con lo dispuesto en el citado Articulo 94 a) del mencionado Convenio, en ciento veintiocho el numero de Estados contratantes cuya ratificacion es necesaria para que dicha propuesta de enmienda entre en vigor;
3. RESUELVE que el Secretario General de la Organizacion de Aviacion Civil Intemacional redacte un Protocolo en los idiomas espahol, arabe, chino, fi-ances, ingles y mso, cada uno de los cuales tendra la misma autenticidad, que contenga la enmienda anteriormente mencionada, asi como las disposiciones que se indican a continuacion: a) El Protocolo sera firmado por el Presidente y el Secretario General de la Asamblea. b) El Protocolo quedara abierto a la ratificacion de todos los Estados que hayan ratificado el mencionado Convenio sobre Aviacion Civil Intemacional o se hayan adherido al mismo. c) Los instrumentos de ratificacion se depositaran en la Organizacion de Aviacion Civil Intemacional. d) El Protocolo entrara en vigor con respecto a ios Estados que lo hayan ratificado en la fecha en que se deposite el centesimo vigesimo octavo instrumento de ratificacion. e) El Secretario General comunicara inmediatamente a todos los Estados contratantes la fecha de deposito de cada una de las ratificaciones del Protocolo. f) El Secretario General notificara inmediatamente la fecha de entrada en vigor del Protocolo a todos los Estados contratantes de dicho Convenio, g) El Protocolo entrara en vigor respecto a todo Estado contratante que lo ratifique despues de la fecha mencionada a partir del momento en que se deposite su instrumento de ratificacion en la Organizacion de Aviacion Civil Intemacional. PGR CONSIGUIENTE, en virtud de la decision antes mencionada de la Asamblea, El presente Protocolo ha sido redactado por el Secretario General de la Organizacion. EN TESTIMONIO DE LO CUAL, el Presidente y el Secretario General del mencionado trigesimo noveno periodo de sesiones de la Asamblea de la Organizacion de Aviacion Civil Intemacional, debidamente autorizados por la Asamblea, firman el presente Protocolo. HECHO en Montreal el seis de octubre de dos mil dieciseis en un documento unico redactado en los idiomas espaflol, drabe, chino, jfrances, ingles y mso, teniendo cada texto igual autenticidad. El presente Protocolo quedara depositado en los archivos de la Organizacion de Aviacion Civil Intemacional y el Secretario General de la Organizacion transmitira copias certificadas del mismo a todos los Estados contratantes del Convenio sobre Aviacion Civil Intemacional hecho en Chicago el dfa siete de diciembre de 1944. 1. APPROVES, in accordance with the provisions of Article 94(a) of the Convention aforesaid, the following proposed amendment to the said Convention: "In Article 50(a) of the Convention the second sentence shall be amended by replacing 'thirty-six' by 'forty'.";
2. SPECIFIES, pursuant to the provisions of the said Article 94(a) of the said Convention, one hundred and twenty-eight as the number of Contracting States upon whose ratification the proposed amendment aforesaid shall come into force;
3. RESOLVES that the Secretary General of the International Civil Aviation Organization draw up a Protocol, in the English, Arabic, Chinese, French, Russian and Spanish languages, each of which shall be of equal authenticity, embodying the amendment above-mentioned and the matter hereinafter appearing: a) The Protocol shall be signed by the President of the Assembly and its Secretary General. b) The Protocol shall be open to ratification by any State which has ratified or adhered to the said Convention on Intemational Civil Aviation. c) The instruments of ratification shall be deposited with the International Civil Aviation Organization. d) The Protocol shall come into force in respect of the States which have ratified it on the date on which the one hundred and twenty-eighth instrument of ratification is so deposited. e) The Secretary General shall immediately notify all Contracting States of the date of deposit of each ratification of the Protocol. f) The Secretary General shall immediately notify all Contracting States to the said Convention of the date on which the Protocol comes into force. g) With respect to any Contracting State ratifying the Protocol after the date aforesaid, the Protocol shall come into force upon deposit of its instrument of ratification with the International Civil Aviation Organization. CONSEQUENTLY, pursuant to the aforesaid action of the Assembly, This Protocol has been drawn up by the Secretary General of the Organization.
