PASAL 10
MULAI BERLAKU, JANGKA WAKTU DAN PENGAKHIRAN
1. Persetujuan ini wajib mulai berlaku 30 (tiga puluh) hari sejak tanggal diterimanya
pemberitahuan tertulis terakhir dimana Para Pihak saling memberitahukan,
melalui saluran diplomatik, bahwa semua persyaratan untuk mulai berlakunya
Persetujuan ini, yang telah ditetapkan oleh undang-undang nasional masing-
masing Pihak telah terpenuhi.
2. Persetujuan ini berlaku untuk jangka waktu yang tidak ditentukan
3. salah satu Pihak dapat mengakhiri persetujuan ini dengan memberikan
pemberitahuan secara tertulis kepada Pihak lain melalui saluran diplomatik.
Pengakhiran Persetujuan iniwajib berlaku setelah 90 (sembitan puluh) hari dari
tanggalditerimanya pemberitahuan tertulis terkait pengakhiran persetujuan
inidari Pihak lainnya.
SEBAGAI BUKTI, yang bertanda tangan di bawah ini, telah diberi kuasa oleh
Pemerintahnya masing-masing, telah menandatangani persetujuan ini,

masing dalam Bahasa lndonesia, Bahasa Montenegro dan Bahasa lnggris, semua
naskah memiliki kekuatan hukum yang sama. Dalam hal terjadi perbedaan
penafsiran dari Persetujuan, naskah Bahasa lnggris wajib berlaku.

DrZavljani bilo koje strane, nosioci diplomatskih i sluibenih paso5a, koji
su dlanovi diplomatskih misija ili konzularnih predstavniStava, kao i
predstavnici medunarodnih organizacija, akreditovani na teritoriji druge
Strane, ukljudujuii i Elanove porodice, obavezni su da od diplomatske
misije ili konzularnog predstavniStva drZave druge strane, prije ulaska,
pribave odgovaraju6u ulaznu vizu.

USLOVI ULASKA I IZLASKA
Drzavljani bilo koje strane, nosioci diplomatskih i sluibenih pasoSa,
nazna6eni u 6lanu 1 ovog sporazuma, mogu da uctu i da napuste teritoriju
driave druge strane na bilo kom granidnom prelazu otvorenom za
medunarodni saobra6aj.

Trajanje validnosti paso5a driavljana bilo koje strane mora biti najmanje
6 (5est) mjeseci prije njihovog ulaska na teritoriju druge Strane.

PRAVA NADITZTTTN ORGANA
1. ovim sporazumom se ne izuzimaju driavljani drZave bilo koje strane,
nosioci diplomatskih i sluibenih paso5a, od obaveze da po5tuju zakone i
propise koji su na snazi na teritoriji driave druge Strane.
2. ovim sporazumom se ne ogranidava pravo nadleznih organa bilo koje
strane da zabrane ulazak ili skrate boravak na njenoj teritoriji
drZavljanima drZave druge Strane, naznadenim u dlanu 1 ovog
sporazuma, koji se smatraju nepoZeljnim ili se smatra da mogu da
ugroze javni mir, iavni poredak, iavno zdravlje ili nacionalnu
bezbjednost.

PRTVREMENO OBUSTAVLJANJE PRIMJENE
1. Svaka strana mo2e privremeno da obustavi, u cjelini ili djelimidno,
primjenu ovog sporazuma, iz razloga nacionalne bezbjednosti, javnog
reda ili javnog zdravlja.
2. Druga Strana mora biti informisana unaprijed, diplomatskim putem u
roku od 30 (trideset) dana, o privremenom obustavljanju sporazuma i
njegovom ponovnom stupanju na snagu.
3. Privremeno obustavljanje primjene ovog sporazuma ne6e se odnositi na
prava drzavljana, naznadenih u dlanu 1 ovog sporazuma koji vei borave
na teritoriji drZave druge Strane.

UZORCI I IZDAVANJE PASOSA T PUTNIH LISTOVA
1. Strane 6e diplomatskim putem razmijeniti uzorke svojih diplomatskih i
sluZbenih pasoSa u roku od 30 (trideset) dana od dana stupanja na
snagu ovog sporazuma,
2. Ukoliko dode do uvodenja novih diplomatskih i sluZbenih paso5a, ili
izmjene postoje6ih, strane 6e o tim izmjenama obavijestiti jedna drugu
u pisanom obliku, diplomatskim putem, najkasnije 30 (trideset) dana
prije njihovog stavljanja u upotrebu.
3. U sludaju da driavljani drZave bilo koje Strane izgube ili oitete vaZeii
pasoS naznaden u dlanu 1 ovog sporazuma, potrebno je da o tome
odmah obavijeste nadle2ne organe u drzavi prijema preko diplomatskog
ili konzularnog predstavni5tva, u cilju odgovarajuieg djelovanja.
Diplomatska misija ili konzularno predstavnistvo, u skladu sa zakonima
i propisima svoje zemlje, izdade tom licu novi pasos ili putni dokument
za povratak u zemlju porijekla.

TZMJENE I DOPUNE
ovaj sporazum se moie izmijeniti ili dopuniti uzajamnom pisanom
saglasnoiiu strana. Izmjene ili dopune ie stupiti na snagu u skladu sa
uslovima naznadenim u dlanu 10 stav 1 ovog sporazuma, i predstavljaie
sastavni dio ovog sporazuma.

TTSAvANJE spoRovA
Sve razlike ili sporovi koji nastanu izmedu Strana u pogledu tumadenja ili
primjene ovog sporazuma rje3avaie se prijateljski, konsultacijama ili
pregovorima izmedu strana diplomatskim putem, bez uticaja bilo koje
treie strane ili medunarodnog suda.

STUPAN]E NA SNAGU, TRAJANJE I RASKID
1. ovaj sporazum stupa na snagu 30 (trideset) dana od dana prijema
posljednjeg pisanog obavjestenja u kojem Strane obavjestavaju jedna
drugu, diplomatskim putem, da su okondane sve unutrainje procedure,
propisane unutrasnjim zakonodavstvom za njegovo stupanje na snagu.
2. Ovaj sporazum se zakljuduje na neodredeno vrijeme.
3. svaka strana moie raskinuti ovaj sporazum dostavljanjem pisanog
obavjeitenja drugoj strani, diplomatskim putem. sporazum prestaje da
vazi 90 (devedeset) dana od datuma prijema posljednjeg pisanog
obavjeStenja o raskidu.
u potvrdu eega su dolje potpisani, propisno ovlaiieni, potpisali ovaj
sporazum.

primjerka, svaki na indonezanskom, crnogorskom i engleskom jeziku, pri
demu su svi tekstovi podjednako vjerodostojni. u slueaju razlika u
tumadenju ovog sporazuma, mjerodavan je tekst na engleskom jeziku.

ARTICLE2
VISA FOR MEMBERS OF DIPLOMATIC OR CONSULAR OFFICES
Nationals of either Party who are holders of diplomatic and service passports and
assigned as members of diplomatic missions or consular posts as well as
representatives of international organizations, located in the territory of the other
Party, including their family members, shall be required to obtain appropriate entry
visa from the diplomatic mission or consular post of the other Party, prior to their
entry.

Nationals of either Party, holders of valid diplomatic and service passports mentioned
in Article 1 of this Agreement, may enter and leave the territory of the other Party at
any border crossing points designated for international passenger traffic.
ARTICLE 4
DURATION OF PASSPORT VALIDITY
The duration of passport validity of nationals of either Party shall be at least 6 (six)
months before entering the territory of the other Party.
ARTICLE 5
THE RIGHTS OF AUTHORITIES
1. This Agreement shall not exempt nationals of the either party, holders of
diplomatic and service passports, from the obligation to respect the laws and
regulations enforced in the territory of the other Party.
2. This Agreement does not affect the right of competent authorities of either Party to
refuse admission or to shorten the stay in its territory of nationals of the other
Party, specified in Article 1 of this Agreement, who are considered undesirable or
likely to endanger public peace, public order, public health or national security.
ARTICLE 6
SUSPENSION
1. Either Pafi may temporarily suspend, partly or entirely, the implementation of this
Agreement for reasons of national security, public order or public health.
2. The other Party must be notified through diplomatic channelwithin 30 (thifi) days
in advance about the suspension and re-entering into force of this Agreement.

3. The suspension of the implementation of this Agreement shall not affect the rights
of nationals, mentioned in Article 1 of this Agreement, who already stay in the
territory of the receiving State.
ARTICLE 7
SPECIMEN AND ISSUANCE OF PASSPORTS OR TRAVEL DOCUMENTS
1' The Parties shall exchange specimens of their diplomatic and service passports
through diplomatic channels within 30 (thirty) days of the entry into force of this
Agreement.
2. ln case of introduction of new diplomatic and service passports, as well as
modifications of the existing ones, the Parties shall immediately inform the
specimens of the said passports to each other in writing, through diplomatic
channels, about any changes not later than 30 (thirty) days prior to their official
introduction.
3. lf a national of either Party loses or damages his or her valid passporl referred to
in Article 1 of this Agreement, he or she shall inform the relevant authorities of the
receiving Party, through diplomatic mission or consular post, for appropriate
action. The relevant diplomatic mission or consulate post shall issue a new
passport or travel document to the aforementioned citizen for returning to the
country of his or her nationality, in conformity with the legislation of his or her
country.
ARTICLE 8
AMENDMENTS
This Agreement may be amended by mutual written consent of the Parties. Such
amendment shall enter into force according to the provision of Paragraph 1 of Article
10 of this Agreement, and shall form as an integral part of this Agreement.
ARTICLE 9
DISPUTE SETTLEMENT
Any difference or dispute arising between the Parties on the interpretation or
implementation of this Agreement shall be settled amicably through consultations or
negotiations between the Parties through diplomatic channels without reference to
any third party or an international tribunal.

ARTICLE 1O
ENTRY INTO FORCE, DURATION AND TERMINATION
1. This Agreement shall enter into force 30 (thirty) days from the date of the receipt
of the last written notification in which the Parties inform each other, through
diplomatic channels, that all requirements for the entry into force of th-is
Agreement, as stipulated in their respective internal procedures, have been
fulfilled.
2. This Agreement shall remain in force for an indefinite period of time.
3. Either Party may terminate this Agreement by giving written notification to the
other Party through diplomatic channels. The termination shall take effect g0
(ninety) days after the date of receipt of the written notification of termination by
other Party.
