PASAL 10
Pemberlakuan, Masa Berlaku dan Pengakhiran
1. Persetujuan ini mulai berlaku 30 (tiga puluh) hari dari tanggal pemberitahuan tertulis terakhir dari para pihak yang saling memberitahukan, melalui saluran diplomatik, bahwa semua persyaratan hukum internal untuk pemberlakuan Persetujuan ini sebagaimana diatur oleh perafuran nasional masing-masing telah terpenuhi.
2. Persetujuan ini wajib berlaku untuk periode 5 (lima) tahun. Selanjutnya, akan diperpanjang secara otomatis untuk periode yang sama dan berturut- turut kecuali salah satu Pihak mengakhiri persetujuan ini.
3. Salah satu pihak wajib memberitahukan kepada Pihak lainnya mengenai maksud untuk mengakhiri Persetujuan ini secara tertulis melalui saluran diplomatik 30 (tiga puluh) hari seberum tanggat pengakhiran yang diinginkan. sebagai bukti, yang bertanda tangan di bawah ini, telah menandatangani Persetujuan ini. Dibuat di Jakarta pada tanggal Enam Belas bulan Oktober tahun Dua Ribu Tujuh Belas, dalam rangkap dua, masing-masing dalam bahasa lndonesia, bahasa Perancis, dan bahasa lnggris, semua naskah memiliki kekuatan yang sama. Dalam hal terjadi perbedaan dalam penafsiran, naskah dalam bahasa lnggris yang berlaku. 2. Les ressortissants vis6s d l'alin6a 1 du pr6sent Article ne sont pas autorisds i exercer un emploi payant pour lequel un permis de travail est requis par la 169islation nationale. Article 2 Visa des Membres des Missions diplomatiques et consulaires Les nationaux de chaque Partie, d6tenteurs de passeports diplomatique ou de service en cours de validit6 et envoyEs comme membres de rnission diplomatique ou consulaire ou d'une organisation internationale dans le territoire de I'autre Partie, doivent obtenir avant leur d6part, le visa d'entr6e appropri6 auprds des Missions diplomatiques ou consulaires de l'autre Partie. Le Ministdre des Affaires Etrangdres de I'Etat d'envoi notifiera avant le d6part, au Ministere de I'Etat d'Accueil, leur aniv6e. Article 3 Validit6 du passeport Les ressortissants d'une Partie, dEsirant entrer dans le territoire de I'autre Partie, doivent €tre munis de Passeport diplomatique ou de service ayant une dur6e de validit6 d'au moins six (6) mois. Article 4 Conditions d'Entr6e et de Sortie Les d6tenteurs de passeports diplomatique ou de service de chaque Partie vis6s dans le pr6sent Accord doivent entrer,transiter ou sortir du territoire de I'autre Partie par les points internationaux autoris6s par les autorit6s d'immigration comp6tentes, sans aucune restriction, d l'exception de celles pr6vues par les dispositions relatives ir la s6curit6, la migration, les douanes, la sant6 et autres qui leur restent applicables. 4 '''{' * ..$l i I r t- E!' 1. Chaque Partie se r6serve le droit de refuser l'entr6e, d'€courter la dur6e ou de mettre fin au s6jour de tout ressortissant de l'autre Partie dans son territoire, s'il considdre que cette personne tend i 6tre ind6sirable ou A mettre en danger l'ordre public, la sant6 publique, la moralit6, la s0ret6 publique ou la s6curit6 nationale.
2. Les ressortissants de chaque Partie sont tenus d'observer les lois et riglements de I'autre Pade une fois dans le terr"itoire de cete Partie , et ne doivent pas, en raison de cet Accord, 6tre exempt6s de leur obligation du respect du droit interne respectif.
3. Le Pr6sent Accord n'affecte pas les lois et rdglements des deux pays relatifs i la s6curit6 int6rieure et d I'entr6e, le transit, le s6jour, ou le mouvement des 6trangers. Article 6 Suspension
1. chaque Partie pourra suspendre la mise en euvre de tout ou partie du pr€sent accord, pour des raisons d'ordre public, de s0ret6 ou de sant6 publique, de s6curit6 .intdrieure ou de catastrophes naturelles. Cette suspension doit A I'avance 6tre d0ment notifi6e i l'autre Partie par voie diplomatique. La m6me proc6dure s'appliquera lorsque la suspension est lev6e.
2. La suspension de tout ou partie du pr6sent Accord n'affectera pas les ressortissants d'une Partie d6tenteurs de passeports diplomatique ou de service admis sous l'article 1 du pr6sent Accord i entrer, et d6ji pr6sents sur le terrtoire de I'autre Partie, dans ce point de la suspension.
3. La suspension prend etfet imm6diatement aprds que notification a 6t6 faite i I'autre Partie. Article 7 Echange des Specimens de Passeports
1. Les Parties pr6c6deront par la voie diplomatique, a l'6change des sp6cimens de leurs passeports diplomatique et de service en vigueur, dans les trente (30) jours suivant la signature du pr6sent Accord.
2. En cas de mise en circulation de nouveaux passeports diplomatique ou de seryice, ou de modification de ceux existants, I'une et l'autre Parties s'informent par 6crit, suivant les canaux diplomatiques, de tous changements, et se d6livrent les sp6cimens au plus tard trente (30) jours avant leur introduction officielle.
3. En cas de perte par les ressortissants de chaque Partie ou de destruction de leurs passeports diplomatique ou de service dans le territoire de I'autre Partie, ils doivent imm6diatement en informer les autorit6s comp6tentes de la Partie d'accueil d travers la mission diplomatique ou consulaire de leur pays de nationalit6. La mission diplomatique ou consulaire concern6e, dtablira aux personnes susmentionn6es, en conformit6 avec la lEgislation en vigueur dans leurs pays respectifs, un nouveau passeport ou tout autre document de voyage et en inforrne les autorit6s comp6tentes de la Partie d'accueil. Article 8 Reglement des Diff6rends Tout diff6rend ou litige relatif d l'interprdtation ou A la mise en euvre du pr6sent Accord sera 16916 i I'amiable d travers des consultations ou des n6gociations directes entre les Parties. Article 9 Amendements Le pr6sent accord peut €tre amend6 d tout moment, par consentement mutuel 6crit des Parties, i travers le canal diplomatique. Lesdits amendernents entreront en vigueur d la date de la notification par laquelle les Parties se notifient I'accomplissement des proc6dures internes h6cessaires d cet effet, et constitueront une Partie int6grale de I'Accord initial. -.'&.-.*r.- il I Article 10 Entr6e en vigueur, Dur6e et Extinction
1. Le pr6sent accord entrera en vigueur trente (30) jours aprds la date de la dernidre notification 6crite par laquelle les Parties s'informent I'une et I'autre, par voie diplomatique, de l'accomplissement des formalit6s l6gales internes pour l'entr6e en vigueur de cet Accord telles que pr6vues par leurs legislations nationales respectives.
2. Le pr6sent Accord restera en vigueur pour une p6riode de cinq (s) ans. par la suite, il sera automatiquement renouvel6 pour des p6riodes similaires successives, i moins que une Partie ne le d6nonce.
3. Chaque Partie pourra notifier par 6crit, A I'autre Partie, suivant le canal diplomatique, son intention de mettre fin i I'accord, trente (30) jours avant ladite terminaison. En foi de quoi, les soussignds, ont sign6 le prEsent Accord. 2. Nationals of the Parties mentioned in paragraph 1 of this Article shall not be permitted to undertake paid employment for which a work permit is required under the national legislation of the Parties. Article 2 Visa for Members of Diplomatic and Consular Missions Nationals of either Pa$ who are holders of valid diplomatic or service passports assigned as members of diplomatic or consular missions or international organizations in the territory of the other Party, inctuding their family members, shall be required to obtain appropriate entry visa from the diplomatic or consular missions of the other Party prior to the entry. Prior to their departure, the Ministry of Foreign Affairs of the Sending State shall notify their arrival to the Ministry of Foreign Affairs of the Receiving State. Article 3 Passport Validity Nationals of one Party desiring to enter into the territory of the other Party shall be fitted with diplomatic or service passport with a period of validity of at least 6 (six) months. Article 4 Entry and Exit Gonditions Holders of valid diplomatic or service passports of either Party referred to in this Agreement, shall enter into, transit, and depart from the territory of the other Party through international checkpoints authorized for that purpose by the competent immigration authorities, without any restrictions, except for those stipulated in the security, migratory, customs, sanitary, and other provisions which may be legally applicable to holders of such varid passports. Article 5 Powerc of the Authorities
1. Each Party reserves the rights to refuse admission of entry, shorten the duration or end the stay of any national of the other Party in its territory, if it F I I,i ta * * i ,.1 I B itir :":-:itE r--: .s: .}j.;*..s1" -.* 'l 6 ,$ considers that person is found to be undesirable or likely to endanger public order, public health, moralig, public safety or national security.
2. Nationals of either Party shall comply with the laws and regulations of the other Party whilst in that Party's territory, and shall not, by reason of this Agreement, be exempt from their obligation to comply with the respective domestic law.
3. This Agreement does not affect the applicable laws and/or regulations of the two countries relating to internal security and the entry, transit, stay or movement of foreigners. Article 6 Suspension
1. Either Party may suspend the implementation of this Agreement either in whole or in part for the reasons of public order, public security, public health, national security or natural disasters. This suspension shall be duly notified in advance to the other Party through diplomatic channels. The same procedure shall apply when suspension comes to end.
2. The suspension of this Agreement in whole or in part, shall not affect nationals of a Party holding valid diplomatic or service passports who have been granted entry into and are already present in the territory of the other Party under Article 1 of this Agreement at the point of suspension.
3. The suspension shall take effect immediately after notification has been given to the other Party. Article 7 Exchange of Passports Specimens
1. The Parties shall exchange the specimens of their valid diplomatic and service passports through diplomatic channel, within 30 (thirty) days following the signing of this Agreement.
2. ln case of introduction of new diplomatic or service passports, as well as modifications of the existing ones, the Parties shall inform each other in writing, through diplomatic channels, about any changes and deliver the specimen not later than 30 (thirty) days prior to their official introduction. -ir rq: ffil $ i II * I {t 'I I $t I r# * .:;.--;*----:*t. :il I I * i,i Iq I I 4
3. ln case of nationals of either Party lose or damage their diplomatic or service passports in the territory of the other Party, they shall immediately inform the competent authorities of the receiving Party through diplomatic or consular mission of the country of their nationality. The diplomatic or consular mission concerned shall issue to the aforementioned persons, in conformity with the legislation of their respective countries, a new passport or travel document and inform such issuance to the competent authorities of the receiving Party. Article 8 Settlement of Disputes Any difference or dispute relating to the interpretation or implementation of this Agreement shall be settled amicably through consultations or direct negotiations between the Parties. Article 9 Amendments This Agreement may be amended at any time by mutual written consent of the Parties through diplomatic channels. Such amendments shall come into effect on the date of the last notification by which the Parties notify each other of the completion of internal procedures necessary for this purpose and shall constitute as an integral part of this Agreement. 1. This Agreement shall enter into force 30 (thirty) days after the date of the last written notification in which the Parties inform each other, through diplomatic channels, that all internal legal requirements for the entry into force of this Agreement as stipulated by their respective national legislation have been fulfilled.
2. This Agreement sharr remain in force for a period of 5 (five) years. Thereinafter, it shall be automatically renewed for similar and successive periods unless terminated by either party. $i I ;t tt $ [' *, I * I 6 e I & I
3. Either Party shall notify the other PaO of its intention to terminate this Agreement in writing through diplomatic channel 30 (thirty) days prior to the intended date of termination. l.
