Artlcle OPerating Authori zat igas Each Cont.ractlng Party shal l have the rlght to deslgnate ln writlng to the other corrtracting Party one a.l nllne for the purpose of openating the ,1 ct reil(l servlces on the specified routes. On recelpt of Contracting Party of paragraphs (4) delay grant to appropri ate ope rat such designation, tlre other shall, subJect to the Pnovisjons and {5) of this Artlcle, vrIttr'ltrt the designatecl airlirre the lno authorizations. 4. Each Contractlng Party shalI have the right' by written notification to the other Contracting P;rrtv, to withdraw the designatlon of any such airline and to deslgnate another one. The alrllne deslgnated by either Corrtractirrg Party may be required to satlsfy the other Contracting Party that lt ls quallflecl to fulfil the conclltions prescrlbed by the laws and regulat'ions hormctl ly and reasonably applled by this Contractlng Party to the operatIon of intennational alr servlces ln conformi ty wl th the provl sions of the Convent ion 5. When an airline has been so rlesignatecl arrcl authorlze.d, 'l t may at any tlme be91n to operate the agreed servlces, provlded that a tari ff establ I shecl ln accondance wl th the provl slons of Article (9) of the preseht Agreement i s j n force and an agneement ln aceordance wlth the provislons of Article (5) of the present Agreement has been reachecr in respect of that sei-vlce. Anticle Strsnension and Revocatlon Each Contractlng Party shall have the rlght to revoke the operatlng author'l zation or to suspencl the exerelseo|therightsspeclfiedinArtjc.|e|2\of the present Agreement by the air'l ine <l esigncftecl by the other Cotrtractlnq Party, or to impose such condltlons as tt may deem necessary on the exercise of these rlghts : (a) 'l n any case wltere lt is not satisf led that substantl al ownershl p ancl effectl ve control of that alrllne are vested ln the contractlng party designatlng the al rl lne oLi n national s of such Contracting PartY, or (b) in tlte case of failure by that alrlirre to comply with the laws or regulatiorrs of the Contractlng Panty grant'irrg these rights, or- (c) lrr case the airline otherwlse fails to ol)erate in accordance wlth the conclitions l)rescribed unden the pneserrt Agreernent. Article Capacity Provisiorrs l. 2. Article Recognl tion of Certl flcates and Licences Centlflcates of alrworthlness, certificates of competency and licences lssued on renderecl valicl by one contractlng Party, and stlrl rn force, sharr rre recognlsed as valid by the other contractlng party for the purpose of operatrng the agreecr serv.rces. Each contractlng Party neserves the rlght, however. to refuse to reeognlze, for the purpose of f lrght arrove its own ternltory. certlflcates of competency ancr... Article lO Financial Provisions Each Contractlng Party shall grant to the designated air'l lne of the other Contnacting Party the right to tnansfen the excess of recel pts over expendi ture earned by that alrllne ln the terrltony of the flnst Contractlng Party ln connectlon wlth the carrlage of trafflc Jn accordance wlth the forelgn exchange negulatloni ln force, at the offlcial prevai I ing rate of exchange where such a rate exjsts or otherwlse at a rate equivalent to that at which recel pts were earned. 2. The transfer shall be effected ln a fnee convertible forel gn exchange. l{here a speclal payment agreement exi st's betweerr the Contract'lng Parties, payments shal'l be effected in accordance wi th the provl sions of tfrat Agreement. Artlcle ll Representatlon, TJcket.ing and Sales pnornoti.on SubJect to the laws and regulations of the other contractlng Party the deslgnatecl airrine of each Contracting Party shall have an equal oplrortunity : 6. (a) to employ the technical and commerclal personnel for the performance of the agreed serv'l ces on the specl fled routes and to establ t sh and operate of f lces ln the terrltory of the other contracting PartYi (b) to lssue al'l klnds of documents of carriage artd to advertlse and to promote sales in the terrltory of the other Contracting Party. Artlcle l2 Consultations and Hocl lflcations In a splrlt of close co-operatlon. the aeronautical authonltles of the Contractlng Partles shall consult each other from tlme to tlme wlth a view to eftsuning the lmplementatjon of, and sat l sfactory compl l ance wi th, the provl sions of the present Agreement and the Annexes thereto. lf elther of the Contracting parties considers it desl rable to modi fy any provi sio^s of the present Agreement, 'l t may recluest consultation witlr tfre other corrtracting Party.
