PASAL 1

Objek dan Ruang Lingkup Persetujuan
Pejabat yang berwenang dari Para Pihak harus memberikan bantuan melalui
pertukaran informasi yang dianggap relevan dengan administrasi dan
penegakan hukum domestik dari Para Pihak mengenai pajak-pajak yang
dicakup oleh Persetujuan ini. lnformasi tersebut harus mencakup informasi
yang relevan dengan penentuan, penilaian, penegakan hukum, penagihan atau
pengembalian
pajak
tersebut,
atas
orang/badan
sehubungan
dengan
pengenaan pajak, pemeriksaan pajak, atau penuntutan pidana perpajakan
dalam kaitannya dengan orang/badan tersebut. lnformasi akan dipertukarkan
sesuai dengan ketentuan dalam Persetujuan ini dan dijaga kerahasiaannya
sebagaimana diatur dalam Pasal 8. Hak-hak dan jaminan perlindungan
terhadap
orang/badan
sesuai
dengan
undang-undang
atau
ketentuan
administrasi Pihak yang diminta informasi tetap berlaku selama hal tersebut
tidak terlalu menghalangi atau menunda pertukaran informasi yang efektif.

PASAL 2

Yurisdiksi
Pihak yang dimintakan informasi tidak berkewajiban untuk memberikan
informasi yang tidak dipegang oleh otoritasnya, ataupun tidak dimiliki atau
dikuasai atau didapat oleh orang/badan yang
berada dalam yurisdiksi
teritorialnya.

PASAL 3

Pajak-Pajak Yang Tercakup dalam Persetujuan lni
1. Pajak-pajak yang tercakup dalam Persetujuan ini adalah:
a) di Republik San Marino:
(i)
Pajak Penghasilan Pajak secara umum yang dikenakan terhadap
aa) perseorangan;
bb) badan hukum dan kepemilikan;
(ii)
Pajak Imper (lmposta Monofase sulle importazioni).
b) di Indonesia:
(i)
Pajak Penghasilan;
(ii)
Pajak Pertambahan Nilai.
2. Persetujuan ini berlaku pula untuk semua pajak yang serupa atau pada
hakekatnya sama yang dikenakan setelah tanggal penandatanganan
Persetujuan ini sebagai tambahan terhadap, atau sebagai pengganti dari
pajak-pajak sejenis yang dikenakan setelah tanggal penandatanganan
persetujuan sebagai tambahan terhadap atau sebagai pengganti pajak-
pajak yang sekarang berlaku, jika Pejabat yang berwenang dari Para Pihak
menyetujui. Pejabat-pejabat yang berwenang dari Para Pihak akan
memberitahukan satu sama lain setiap perubahan penting dalam ketentuan
perundang-undangan perpajakan dan tatacara mendapatkan informasi yang
terkait sebagaimana dicakup oleh Persetujuan ini.

PASAL 4

Pengertian Umum

1. Dalam Persetujuan ini, yang dimaksud dengan istilah: a) "Republik San Marino", bila diartikan secara geografis, berarti wilayah Republik San Marino, termasuk daerah di dalamnya dimana Republik San Marino, berdasarkan hukum internasional, menjalankan hak-hak kedaulatan dan yurisdiksinya; b) "Indonesia" meliputi wilayah Republik Indonesia sebagaimana dirumuskan dalam ketentuan perundang-undangannya dan bagian- bagian landas kontinen, zona ekonomi ekslusif, dan lautan sekitarnya yang berbatasan di mana Republik Indonesia memiliki kedaulatan, hak- hak kedaulatan atau yurisdiksi sesuai dengan ketentuan di dalam Konvensi Perserikatan Bangsa-bangsa tentang Hukum Laut Tahun 1982; c) "pejabat yang berwenang" berarti: (i) dalam hal Pemerintah Republik San Marino, Menteri Keuangan atau wakilnya yang sah; (ii) dalam hal Pemerintah Republik Indonesia, Menteri Keuangan atau wakilnya yang sah; d) "orang/badan" mencakup orang pribadi, badan hukum atau kumpulan dari keduanya; e) "perseroan" berarti setiap badan hukum atau setiap entitas yang untuk tujuan pemungutan pajak diperlakukan sebagai suatu badan hukum; f) "perseroan masuk bursa" berarti perseroan dimana bagian utama dari kelompok sahamnya terdaftar di bursa efek yang diakui dan saham- 4 saham yang terdaftar tersebut dapat dengan mudah dibeli atau dijual oleh publik. Saham-saham dapat dibeli atau dijual "oleh publik" jika pembelian atau penjualan saham tidak dibatasi baik secara implisit maupun eksplisit kepada sekelompok investor tertentu; g) "bagian utama kelompok saham" berarti bagian atau beberapa bagian dari saham yang mewakili mayoritas hak suara dan nilai perusahaan; h) "bursa efek yang diakui" berarti suatu bursa efek yang disepakati oleh Pejabat yang berwenang dari Para Pihak; i) "dana atau skema investasi kolektif' berarti setiap instrumen pengumpulan investasi, tanpa memperhatikan bentuk hukumnya. lstilah "Dana atau skema investasi kolektif publik" berarti setiap dana investasi kolektif atau skema yang menyediakan unit, saham, atau kepentingan lain di dalam dana atau skema tersebut dapat dengan mudah dibeli, dijual atau ditebus oleh publik/masyarakat umum. Unit, saham, atau kepentingan lainnya dalam dana atau skema dapat dengan mudah dibeli, dijual atau ditebus oleh publik/masyarakat umum jika pembelian, penjualan atau penebusan tidak secara implisit maupun eksplisit terbatas hanya pada kelompok investor tertentu; j) "pajak" berarti setiap jenis pajak yang dicakup oleh Persetujuan ini; k) "Pihak peminta" berarti Pihak yang meminta informasi; I) "Pihak yang diminta" berarti Pihak yang diminta untuk memberikan informasi; m) "tata cara mengumpulkan informasi" berarti hukum dan administrasi atau prosedur hukum yang memungkinkan suatu Pihak mendapatkan dan memberikan informasi yang diminta; 5 n) "informasi" berarti setiap fakta, pernyataan, dokumen atau catatan dalam bentuk apapun; o) "pidana perpajakan" berarti masalah perpajakan yang melibatkan tindakan yang disengaja, baik sebelum maupun sesudah berlakunya Persetujuan ini, yang dapat dituntut berdasarkan hukum pidana dari Pihak Peminta; p) "Hukum pidana" berarti semua peraturan hukum pidana yang ditunjuk di bawah hukum domestik, baik yang terkandung dalam undang-undang pajak, kitab undang-undang hukum pidana atau undang-undang lainnya.

2. Sehubungan dengan diterapkannya Persetujuan ini sewaktu-waktu oleh salah satu pihak, setiap istilah yang tidak didefinisikan dalam persetujuan ini, kecuali jika dari hubungan kalimatnya harus diartikan lain, akan mempunyai arti yang sesuai dengan perundang-undangan negara tersebut, dengan ketentuan bahwa setiap arti yang didasarkan pada undang-undang perpajakan negara tersebut berlaku di atas arti yang didasarkan pada perundang-undangan lainnya dari negara tersebut

Pertukaran lnformasi Berdasarkan Permintaan

1. Pejabat yang berwenang dari Pihak yang diminta harus memberikan, atas permintaan dari Pihak Peminta, informasi untuk tujuan sebagaimana dimaksud dalam Pasal 1. lnformasi tersebut akan dipertukarkan tanpa memperhatikan apakah Pihak yang diminta membutuhkan informasi tersebut untuk tujuan perpajakannya sendiri atau perbuatan yang diperiksa akan merupakan tindak pidana menurut hukum Pihak yang diminta jika perbuatan tersebut terjadi di wilayah Pihak yang diminta. Pejabat yang berwenang dari Pihak Peminta hanya akan membuat permintaan untuk informasi berdasarkan Pasal ini jika tidak bisa memperoleh informasi yang diminta 6 dengan cara lain, kecuali apabila untuk menempuh cara lain tersebut akan menimbulkan kesulitan yang tidak sepadan.

2. Jika informasi yang dimiliki Pejabat yang berwenang dari Pihak yang diminta tidak mencukupi untuk memenuhi permintaan informasi, Pihak yang diminta, berdasarkan kebijakannya, akan menggunakan semua tatacara yang relevan untuk mengumpulkan informasi yang diperlukan guna memberikan informasi tersebut kepada Pihak Peminta, meskipun Pihak yang diminta tidak membutuhkan informasi tersebut untuk tujuan pajaknya sendiri.

3. Jika secara khusus diminta oleh Pejabat yang berwenang dari Pihak Peminta, Pejabat yang berwenang dari Pihak yang diminta wajib memberikan informasi berdasarkan Pasal ini, sepanjang diperbolehkan berdasarkan hukum domestik, dalam bentuk pernyataan saksi dan salinan otentik dari catatan asli.

4. Setiap Pihak harus menjamin bahwa Pihak yang berwenang untuk tujuan sebagaimana disebutkan dalam Pasal 1 dan sesuai dengan Pasal 2 Persetujuan ini, atas permintaan yang diterima, memiliki kewenangan untuk mendapatkan dan memberikan: a) informasi yang dimiliki oleh bank, lembaga keuangan lainnya, dan setiap orang/badan termasuk nominee dan wali, yang bertindak sebagai perantara atau berkapasitas sebagai lembaga penjamin (fidusia); b) (i) informasi mengenai status hukum dan pemilik manfaat sebenarnya atas perusahaan, kemitraan, dan orang/badan lainnya, termasuk informasi kepemilikan atas semua orang/badan dalam sebuah rantai kepemilikan; (ii) dalam hal perwalian, informasi terkait pengelola, wali, dan pemilik kepentingan; 7 - - (iii) dalam hal yayasan, informasi tentang pendiri, anggota komite organisasi, dan pemilik kepentingan; (iv) dalam hal skema investasi kolektif, informasi tentang saham, unit dan kepentingan lainnya; sepanjang Persetujuan ini tidak menimbulkan kewajiban bagi Para Pihak untuk mendapatkan atau memberikan informasi berkenaan dengan perseroan masuk bursa atau dana atau skema investasi kolektif publik kecuali informasi tersebut dapat diperoleh tanpa menimbulkan kesulitan yang tidak sepadan.

5. Setiap permintaan informasi harus dibuat sedetail mungkin dan harus menyampaikan secara tertulis: a) identitas orang/badan yang diperiksa atau disidik; b) periode informasi yang diminta; c) sifat informasi yang diminta dan bentuk yang diinginkan oleh Pihak Peminta dalam menerima informasi tersebut; d) tujuan perpajakan atas dibutuhkannya informasi tersebut; e) alasan untuk meyakini bahwa informasi yang diminta adalah relevan dengan administrasi dan penegakan hukum bagi Pihak Peminta terkait dengan orang/badan yang diidentifikasi dalam sub ayat (a) ayat ini; f) dasar untuk meyakini bahwa informasi yang diminta dipegang oleh Pihak yang diminta atau dalam kepemilikan atau dalam kekuasaan atau dapat diperoleh dari orang/badan di dalam wilayah yurisdiksi Pihak yang diminta; 8 g) sepanjang diketahui, nama dan alamat setiap orang/badan yang diyakini memiliki atau menguasai atau dapat memperoleh informasi yang diminta; h) pernyataan bahwa permintaan tersebut sesuai dengan hukum dan praktek administrasi Pihak Peminta, bahwa jika informasi yang diminta berada dalam yurisdiksi Pihak Peminta, maka pejabat yang berwenang dari Pihak Peminta akan mampu memperoleh informasi tersebut berdasarkan hukum Pihak Peminta atau sesuai dengan kebiasaan dalam praktik administrasi dan bahwa hal tersebut sudah sesuai dengan Persetujuan ini; i) pernyataan bahwa Pihak Peminta telah melakukan semua cara yang tersedia di wilayahnya sendiri untuk mendapatkan informasi tersebut, kecuall untuk hal-hal yang akan menimbulkan kesulitan yang tidak sepadan.

6. Pejabat yang berwenang dari Pihak yang diminta akan memberitahukan telah diterimanya permohonan permintaan informasi kepada pejabat yang berwenang dari Pihak Peminta dan akan mengupayakan dengan sebaik- baiknya untuk menyampaikan informasi yang diminta kepada Pihak Peminta dengan penundaan seminimal mungkin.

Pemeriksaan Pajak di Luar Negeri
1. Dengan pemberitahuan yang cukup sebelumnya, Pihak Peminta dapat
meminta kepada Pihak yang diminta untuk mengizinkan perwakilan dari
Pejabat yang berwenang dari Pihak Peminta untuk memasuki wilayah Pihak
yang
diminta,
sebatas
yang
diizinkan
menurut
hukumnya,
untuk
mewawancarai individu dan memeriksa catatan dengan persetujuan tertulis
sebelumnya dari individu atau orang/badan lainnya yang terkait. Pejabat
yang berwenang dari Pihak Peminta harus memberitahukan pejabat yang

berwenang dari Pihak yang diminta mengenai waktu dan tempat pertemuan
dimaksud dengan individu yang bersangkutan.
2. Atas permintaan Pejabat yang berwenang dari salah satu Pihak, Pejabat
yang berwenang dari Pihak lainnya dapat mengizinkan perwakilan dari
Pejabat yang berwenang dari pihak yang disebutkan pertama tadi, untuk
hadir pada saat yang diperuntukan dalam pemeriksaan pajak oleh Pihak
yang disebutkan kedua.
3. Jika permintaan sebagaimana dimaksud dalam ayat 2 disetujui, Pejabat yang
berwenang dari Pihak yang melakukan pemeriksaan harus secepat mungkin
memberitahukan Pejabat yang berwenang dari Pihak lainnya tentang waktu
dan tempat pemeriksaan, orang yang berwenang atau pejabat yang ditunjuk
untuk melaksanakan pemeriksaan dan
prosedur serta kondisi yang
dibutuhkan
oleh
Pihak yang
disebutkan
pertama
untuk
melakukan
pemeriksaan.
Semua
keputusan
sehubungan
dengan
pelaksanaan
pemeriksaan pajak harus dibuat oleh Pihak yang melakukan pemeriksaan.

Kondisi Penolakan Permintaan
1. Pejabat yang berwenang dari Pihak yang diminta mungkin menolak untuk
membantu:
a) jika permintaan dibuat tidak sesuai dengan Persetujuan ini;
b) jika Pihak Peminta belum menggunakan semua cara yang tersedia di
wilayahnya sendiri untuk mendapatkan informasi tersebut, kecuali cara
tersebut dapat menimbulkan kesulitan yang tidak sepadan bagi Pihak
Peminta; atau
c) jika pengungkapan informasi yang d~m i nta akan bertentangan dengan
kebijakan publik dari Pihak yang diminta.

2. Persetujuan ini tidak dapat memaksakan kewajiban bagi salah satu Pihak
untuk menyediakan informasi yang merupakan hak istimewa sesuai dengan
hukum domestik Pihak yang bersangkutan, atau rahasia dagang, bisnis,
industri, perniagaan atau keahlian atau proses dagang, sepanjang informasi
yang disebutkan dalam Pasal 5 (4) tidak boleh dianggap sebagai rahasia
atau proses perdagangan semata-mata berdasarkan alasan tersebut.
3. Permintaan informasi tidak dapat ditolak atas dasar bahwa tagihan pajak
yang menjadi dasar permintaan informasi sedang dipersengketakan.

Pihak
yang
diminta
tidak
berkewajiban
untuk
memperoleh
dan
menyampaikan informasi yang tidak mungkin diperoleh berdasarkan
perundang-undangan dari negara tersebut untuk tujuan administrasi atau
penegakan
hukum
pajak
Negara
tersebut
atau
guna
menanggapi
permintaan yang sah dalam keadaan yang serupa dari Pihak yang diminta
berdasarkan Persetujuan ini.
5. Pihak yang diminta dapat menolak suatu permintaan informasi jika informasi
tersebut dibutuhkan oleh Pihak Peminta untuk mengatur atau memaksakan
suatu ketentuan hukum pajak pada Pihak Peminta, atau suatu tuntutan yang
berhubungan, yang mendiskriminasikan warganegara dari Pihak yang
diminta apabila dibandingkan dengan warganegara dari Pihak Peminta
dalam keadaan yang sama.

Kerahasiaan
1.
Semua informasi yang diberikan dan diterima oleh Pejabat yang berwenang
dari Para Pihak harus dijaga kerahasiaannya.
2.
lnformasi yang diberikan kepada Pejabat yang berwenang dari Pihak
Peminta tidak boleh digunakan untuk tujuan selain tujuan yang dinyatakan

dalam Pasal 1 tanpa persetujuan tertulis sebelumnya dari Pihak yang
diminta.
3.
lnformasi yang diberikan hanya dapat diungkapkan kepada orang/badan
atau Pihak yang berwenang (termasuk kekuasaan kehakiman dan
administrasi) sehubungan dengan tujuan yang telah ditetapkan dalam Pasal
1 dan digunakan oleh orang/badan atau otoritas tersebut hanya untuk
tujuan dimaksud termasuk penentuan banding apapun. Untuk tujuan ini,
informasi dapat diungkapkan dalam pengadilan umum
atau dalam
pembuatan keputusan pengadilan.
4.
lnformasi yang diberikan kepada Pihak Peminta yang diatur oleh
Persetujuan ini tidak boleh diungkapkan ke yurisdiksi/pihak lain.

Biaya
Kecuali jika Pejabat yang berwenang dari Para Pihak menyepakati lain, biaya-
biaya dalam batasan tertentu yang dikeluarkan pada saat memberikan bantuan
harus ditanggung oleh Pihak yang diminta, dan biaya diluar batasan tertentu
dalam memberikan bantuan (termasuk biaya untuk melibatkan penasihat
eksternal sehubungan dengan litigasi atau keadaan lainnya) harus ditanggung
oleh
Pihak
Peminta.
Masing-masing
Pejabat
yang
berwenang
harus
berkonsultasi jika diperlukan sehubungan dengan ketentuan Pasal ini, dan
khususnya Pejabat yang berwenang dari Pihak yang diminta harus terlebih
dahulu berkonsultasi dengan Pejabat yang berwenang dari Pihak Peminta jika
biaya untuk memberikan informasi sehubungan dengan permintaan khusus
diperkirakan akan signifikan.

Tata Cara Persetujuan Bersama
1. Apabila timbul kesulitan atau keraguan di antara Para Pihak mengenai
implementasi atau
penafsiran
Persetujuan
ini,
para
Pejabat yang
berwenang
harus
berusaha
untuk
menyelesaikan
masalah
melalui
kesepakatan bersama.
2. Sebagai tambahan dari kesepakatan sebagaimana dimaksud dalam ayat 1,
Pejabat yang berwenang dari Para Pihak dapat saling menyetujui prosedur
yang digunakan dalam Pasal 5, 6 dan 9.
3. Pejabat-pejabat yang berwenang dari Para Pihak dapat berkomunikasi satu
sama lain secara langsung guna mencapai kesepakatan berdasarkan Pasal
ini.
4. Para Pihak juga dapat menyepakati bentuk-bentuk lain penyelesaian
sengketa apabila diperlukan.

PASAL 11

Saat Mulai Berlaku
1.
Masing-masing Pihak akan menyampaikan pemberitahuan tertulis tentang
penyelesaian prosedur yang diperlukan menurut hukum nasionalnya untuk
berlakunya Persetujuan ini.
2.
Persetujuan ini
mulai berlaku pada tanggal terakhir dilakukannya
pemberitahuan tersebut dan kemudian akan berlaku efektif:
a)
pada tanggal tersebut untuk masalah pidana perpajakan; dan
b)
pada tanggal tersebut untuk hal-hal lain yang tercakup dalam Pasal 1,
tetapi hanya sehubungan dengan tahun-tahun pajak yang dimulai

pada atau setelah tanggal tersebut, atau dalam hal tidak ada tahun
pajak, untuk semua pajak yang dikenakan pada atau setelah tanggal
terse but.

Berakhirnya Persetujuan

1. Salah satu Pihak dapat mengakhiri Persetujuan ini dengan menyampaikan pemberitahuan tertulis tentang pengakhiran Persetujuan melalui saluran terkait dari pihak lain yang dipersyaratkan oleh hukum negara tersebut.

2. Pengakhiran Persetujuan tersebut akan berlaku efektif pada hari pertama bulan setelah berakhirnya jangka waktu enam bulan sejak tanggal diterimanya pemberitahuan pengakhiran oleh Pihak lainnya.

3. Jika Persetujuan sudah diakhiri, Para Pihak akan tetap terikat oleh ketentuan-ketentuan Pasal 8 sehubungan dengan informasi yang diperoleh berdasarkan Persetujuan ini. 14 Sebagai bukti, yang bertandatangan di bawah ini, yang diberi kuasa penuh dari pemerintahnya masing-masing, telah menandatangani Persetujuan ini. Dibuat di New York pada tanggal 25 September 2013 dalam tiga rangkap asli berbahasa bahasa Indonesia, ltali, dan lnggris, semua naskah memiliki kekuatan hukum yang sama. Articolo 1 Oggetto e campo di applicazione dell' Accordo Le autorita competenti delle Parti fomiscono assistenza attraverso lo scambio di informazioni che sono verosimilmente pertinenti all'amministrazione ed attuazione delle leggi inteme delle Parti concementi le imposte contemplate nel presente Accordo. Tali informazioni includono informazioni che sono verosimilmente pertinenti alla determinazione, all'accertamento, all'attuazione, alla riscossione o al recupero di tali imposte, in relazione alle persone passibili di tali imposte, ovvero alle indagini in materia fiscale o ai procedimenti in materia fiscale penale relativamente a tali persone. Lo scambio di informazioni ha luogo conformemente alle disposizioni del presente Accardo e secondo le modalita di riservatezza di cui all'Articolo 8. I diritti e le misure di salvaguardia garantiti alle persone dalle leggi o dalla pratica amministrativ.a della Parte richiesta restano applicabili nella misura in cui non impediscono ne ritardano indebitamente lo scambio effettivo di informazioni. Articolo 2 Giurisdizione Una Parte richiesta non e tenuta a fornire informazioni che non siano ne detenute dalle proprie autorita ne in possesso o sotto ii controllo di o reperibili da persone che si trovano nella sua giurisdizione territoriale. Articolo 3 lmposte contemplate 1. Le imposte oggetto del presente Accordo sono: a) in Indonesia: (i) l'imposta sui redditi; (ii) l'imposta sul valore aggiunto. b) nella Repubblica di San Marino: (i) l'lmposta Generale sui Redditi che e prelevata: aa) sulle persone fisiche; bb) sulle persone giuridiche e sulle imprese individuali; (ii) l'lmposta Monofase sulle lmportazioni. 2. II presente Accordo si applica anche alle imposte identiche o sostanzialmente simili applicate successivamente alla data della firma dell'Accordo in aggiunta o in luogo di imposte esistenti qualora le autorita competenti delle Parti lo convengano. Le autorita competenti di ogni Parte si notificano reciprocamente ogni cambiamento sostanziale apportato alla tassazione e alle relative misure di raccolta delle informazioni previste dall'Accordo. 2 Articolo 4 Definizioni 1. Ai fini del presente Accardo con ii termine: a) "Indonesia" si intende ii territorio della Repubblica di Indonesia come definite dalle sue leggi, e parti della piattaforma continentale, zona economica esclusiva e mari adiacenti sui quali la Repubblica di Indonesia ha sovranita, diritti sovrani o giurisdizione ai sensi della Convenzione delle Nazioni Unite sul Diritto del Mare del 1982; b} "Repubblica di San Marino", allorquando utilizzato in sense geografico, si intende ii territorio della Repubblica di San Marino, ivi compreso qualsiasi altro spazio sul quale la Repubblica di San Marino esercita diritti sovrani o ha giurisdizione conformemente al diritto internazionale; c) "autorita competente" si intende: (i) nel caso della Repubblica di Indonesia, ii Ministro delle Finanze o ii suo rappresentante autorizzato; (ii) nel caso della Repubblica di San Marino, ii Ministro delle Finanze o ii suo rappresentante autorizzato; d) "persona" si intende una persona fisica, una persona giuridica o ogni altro organismo di persone; e) "societa" si intende qualsiasi ente giuridico o entita trattata come ente giuridico a fini fiscali; f) "societa commercializzata pubblicamente" si intende qualsiasi societa la cui principale classe di azioni e quotata in una borsa valori riconosciuta, a patto che le azioni quotate in borsa possano essere prontamente acquistate o vendute dal pubblico. Le azioni possono essere acquistate o vendute "dal pubblico" se la compravendita di azioni non e implicitamente o esplicitamente limitata ad un gruppo ristretto di investitori; 3 g) "principale classe di azioni" si intende la classe o le classi di azioni che rappresentano la maggioranza del potere di vote e del valore della societa; h) "borsa valori riconosciuta" si intende qualsiasi borsa valori concordata dalle autorita competenti delle Parti; i) "fondo o schema di investimento comune" si intende qualsiasi veicolo comune di investimento, a prescindere dalla forma giuridica. Con l'espressione "fondo o schema pubblico di investimento comune" si intende qualsiasi fondo o schema di investimento comune, a patto che le quote fondiarie, le quote societarie o altre partecipazioni nel fondo o nello schema possano essere prontamente acquistabili, vendibili o riscattabili dal pubblico. Le quote fondiarie, le quote societarie o altre partecipazioni nel fondo o nello schema possono essere prontamente acquistabili, vendibili o riscattabili "dal pubblico" se l'acquisto, vendita o riscatto non sono implicitamente o esplicitamente limitati ad un gruppo ristretto di i nvestitori; j) "imposta" si intende ogni imposta alla quale si applica ii presente Accordo;, k) "Parte richiedente" si intende la Parte che richiede le informazioni; I) "Parte richiesta" si intende la Parte e a cui e stato richiesto di fomire informazioni; m) "misure per la raccolta di informazioni" si intendono le leggi e ·1e procedure amministrative o giudiziarie che consentono ad una P:arte di ottenere e fornire le informazioni richieste; n) "informazioni" si intende ogni fatto, dichiarazione, documento o registrazione in qualsiasi forma; o) "materia fiscale penale" si intende la materia fiscale che implica una condotta dolosa, precedente o successiva all'entrata in vigore del presente 4 Accordo, passibile di essere perseguita ai sensi delle leggi penali della Parte richiedente; p) "leggi penali" si intendono tutte le leggi penali come tali designate ai sensi del diritto intemo, a prescindere dal fatto che siano contenute nelle leggi tributarie, nel codice penale o in altri statuti. 2. Per quanta conceme l'applicazione del presente Accordo in ogni memento ad opera di una Parte, ogni termine non definite nell'Accordo stesso, a meno che ii contesto non richieda diversamente, ha ii significato che ha in quel memento secondo le leggi di quella Parte, e ogni significato ai sensi delle leggi tributarie applicabili di quella Parte prevale sul significato attribuito a quel termine in base ad altre leggi di quella Parte. Articolo 5 Scambio di informazioni su richiesta

1. L'autorita competente della Parte richiesta fornira, su richiesta della Parte richiedente, le informazioni di cui all'Articolo 1. Tali informazioni saranno scambiate indipendentemente dal fatto che la Parte richiesta ne abbia necessita per i propri fini fiscali o che la condotta soggetta a verifica costituisca reato ai sensi della legislazione della Parte richiesta, nel caso in cui tale condotta sia stata posta in essere sul territorio di quest'ultima Parte. L'autorita competente della Parte richiedente avanzera la richiesta di informazioni ai sensi del presente articolo solo qualora non sia in grado di ottenere dette informazioni mediante altri mezzi, salvo ii case in cui ii ricorso a tali altri mezzi comporti difficolta sproporzionate.

2. Se le informazioni in possesso dell'autorita competente della Parte richiesta non sono sufficienti per consentire a tale Parte di soddisfare la richiesta di informazioni, quella Parte ricorre a sua discrezione a tutte le perfinenti misure per la raccolta di informazioni al fine di fornire alla Parte richiedente le informazioni richieste, anche nel caso in cui la Parte richiesta non necessiti di tali informazioni per i propri fini fiscali. 5

3. Qualora specificatamente interpellata dall'autorita competente di una Parte richiedente, l'autorita competente della Parte richiesta fomira le informazioni ai sensi del presente Articolo, nella misura consentita dalle proprie leggi inteme, sotto forma di deposizioni di testimoni e copie autenticate di documenti originali.

4. Ciascuna Parte assicura che le proprie autorita competenti, per i fini specificati nell'Articolo 1 e conformemente all'Articolo 2 dell'Accordo, abbiano l'autorita di ottenere e fornire su richiesta: a) informazioni detenute da banche, altri istituti finanziari e da ogni soggetto, ivi compresi prestanome e amministratori fiduciari, che agisca in qualita di agenzia o fiduciaria; b) (i) informazioni relative alla titolarita giuridica ed effettiva di societa di capitali, societa di persone e altri soggetti, comprese le informazioni sulla proprieta di tutti i soggetti in una catena partecipativa; (ii) nel caso dei trust, informazioni su disponenti, amministratori (trustee), guardiani e beneficiari; (iii) nel caso delle fondazioni, le informazioni sui fondatori, i membri del consiglio della fondazione e i beneficiari; e (iv) nel caso di schemi comuni di investimento, informazioni sulle quote societarie, quote fondiarie e altre partecipazioni; a condizione che ii presente Accardo non crei per le Parti un obbligo di ottenere o fornire informazioni sulla proprieta di societa quotate in borsa o di fondi e schemi pubblici di investimento comune, purche tali informazioni possano essere ottenute senza dar luogo a difficolta sproporzionate.

5. Qualsiasi richiesta di informazioni sara formulata nella maniera piu dettagliata possibile e specifichera, per iscritto: a) l'identita della persona oggetto di esame o indagine; 6 b) ii periodo per ii quale le informazioni vengono richieste; c) la natura delle informazioni richieste e la forma in cui la Parte richiedente desidera riceverle; d) ii fine fiscale per ii quale si richiedono le informazioni; e) le ragioni che inducono a ritenere che le informazioni richieste siano verosimilmente rilevanti per l'amministrazione e applicazione fiscale della Parte richiedente, per quanto concerne le persone identificate al punto (a) del presente paragrafo; f) i motivi per i quali si ritiene che le informazioni richieste siano detenute dalla Parte richiesta, o che siano in possesso o sotto ii controllo di o reperibili da una persona che rientra nella giurisdizione territoriale della Parte richiesta; g) se conosciuti, ii nome e l'indirizzo di ogni persona ritenuta essere in possesso o in controllo delle informazioni richieste o di poterle reperire; h) una dichiarazione attestante che la richiesta e effettuata in conformita alla legislazione e alle pratiche amministrative della Parte richiedente; che, se le informazioni richieste fossero disponibili nell'ambito della giurisdizione della Parte richiedente, l'autorita competente di detta Parte sarebbe in grade di ottenerle ai sensi della sua legislazione o nel normale corso delle pratiche amministrative; che la richiesta e effettuata in conformita al presente Accordo; i) una dichiarazione attestante che la Parte richiedente ha esperito tutti i mezzi disponibili sul proprio territorio per ottenere le informazioni, ad eccezione di quelli che comporterebbero difficolta sproporzionate. 6. L'autorita competente della Parte richiesta confermera all'autorita competente della Parte richiedente di aver ricevuto la richiesta e fara ii possibile 7 per inoltrare le informazioni richieste alla Parte richiedente nel pill breve tempo possibile. Articolo 6 Accertamenti fiscali all'estero 1. Con un ragionevole anticipo, la Parte richiedente puo richiedere alla Parte richiesta di permettere ai rappresentanti della sua autorita competente di entrare nel territorio della Parte richiesta, nella misura consentita dalla proprie leggi, per interrogare individui ed esaminare documenti con ii preventivo consenso scritto degli individui stessi o di altre persone interessate. L'autorita competente della Parte richiedente notifichera all'autorita competente della Parte richiesta la data e ii luogo della verifica prevista con gli individui interessati. 2. Su richiesta dell'autorita competente di una Parte, l'autorita competente dell'altra Parte puo consentire ai rappresentanti dell'autorita competente della prima Parte menzionata di essere presenti durante la fase appropriata di un accertamento fiscale nella seconda Parte menzionata;

3. Se la richiesta di cui al paragrafo 2 viene accolta, l'autorita competente della Parte che effettua l'indagine notifichera quanto prima all'autorita competente dell'altra Parte: la data ed ii luogo dell'indagine, l'autorita o ii funzionario autorizzato alla conduzione dell'accertamento nonche le procedure e le condizioni richieste dalla prima Parte menzionata per la conduzione dell'accertamento stesso. Tutte le decisioni inerenti alla conduzione dell'accertamento fiscale sono di competenza dalla Parte che conduce tale accertamento. 8 Articolo 7 Possibilita di rifiutare una richiesta 1. L'autorita competente della Parte richiesta puo rifiutare di prestare assistenza: a) qualora la richiesta non sia effettuata in conformita al presente Accordo; b) qualora la Parte richiedente non abbia esperito tutti i mezzi a sua disposizione per l'ottenimento delle informazioni, tranne ii caso in cui ii ricorso a tali mezzi comportasse difficolta sproporzionate; o c) qualora la comunicazione delle informazioni fosse contraria all'ordine pubblico della Parte richiesta. 2. Le disposizioni del presente Accardo non obbligano una Parte a fornire informazioni oggetto di un privilegio legale come previsto dalle leggi interne della relativa Parte o che potrebbero rivelare un segreto commerciale, industriale o professionale o un processo commerciale, purche le informazioni di cui all'Articolo 5, paragrafo 4, non siano considerate come segreto o processo commerciale semplicemente per questa ragione. ---- 3. Una richiesta di informazioni non puo essere respinta adducendo i1 motivo che ii credito fiscale che ha dato luogo alla richiesta e oggetto di contenzioso. 4. La Parte richiesta non sara tenuta ad ottenere e fornire informazioni che la Parte richiedente non potrebbe ottenere ai sensi delle proprie leggi ai fini dell'amministrazione o applicazione delle proprie leggi fiscali o in risposta ad una valida richiesta avanzata in analoghe circostanze dalla Parte richiesta ai sensi del presente Accordo. 5. La Parte richiesta puo rifiutare una richiesta di informazioni se le informazioni sono richieste dalla Parte richiedente per l'amministrazione o 9 attuazione di una disposizione della legislazione fiscale della Parte richiedente, o altro adempimento connesso, che discrimina un cittadino della Parte richiesta rispetto a un cittadino della Parte richiedente nelle medesime circostanze. Articolo 8 Riservatezza 1. Tutte le informazioni fornite e ricevute dalle autorita competenti delle Parti saranno riservate.

2. Le informazioni fornite alla competente autorita della Parte richiedente non potranno essere utilizzate per nessuno scope diverse da quelli di cui all'Articolo 1 senza I' espresso consenso scritto della Parte richiesta.

3. Le informazioni fornite saranno comunicate soltanto alle persone o autorita (ivi comprese le autorita giudiziarie e amministrative) incaricate di perseguire gli scopi di cui all'Articolo 1 e dette persone o autorita utilizzeranno tali informazioni soltanto per tali fini, comprese le decisioni su eventuali ricorsi. Per tali scopi, le informazioni potranno essere comunicate nel corso di udienze pubbliche o nei giudizi. 4. Le informazioni fornite alla Parte richiedente ai sensi del presente Accardo non potranno essere comunicate a nessun'altra giurisdizione. 10 Articolo 9 Cos ti A meno che le autorita competenti delle Parti non concordino diversamente, i costi ordinari sostenuti per la fornitura di assistenza sono a carico della Parte richiesta, rnentre i costi straordinari sostenuti per fornire l'assistenza (cornpresi i costi ragionevoli per consulenti esterni in relazione a contenziosi o altro) sono a carico della Parte richiedente. Le rispettive autorita competenti si consultano allorquando necessario relativamente al presente Articolo. In particolare, l'autorita competente della Parte richiesta si consulta preventivamente con l'autorita competente della Parte richiedente nel case in cui si preveda che i costi per la fornitura di informazioni relativamente ad una specifica richiesta siano cospicui. Articolo 10 Procedura amichevole

1. Laddove insorgano, tra le Parti, difficolta o dubbi in merito all'applicazione o interpretazione dell'Accordo, le autorita competenti dovranno cercare di risolvere la questione mediante procedura amichevole. 2. In aggiunta alla composizione amichevole di cui al paragrafo 1, le autorita competenti delle Parti possono determinare, di comune accordo, le procedure da utilizzare conformemente agli Articoli 5, 6 e 9. 3. Le autorita competenti delle Parti possono comunicare tra loro direttamente al fine di raggiungere un accordo ai sensi del presente articolo. 4. Le Parti possono anche accordarsi su altre forme di composizione delle controversie qualora fosse necessario. 11 I Articolo 11 Entrata in vigore 1. Ciascuna Parte notifichera all'altra per iscritto l'awenuto completamento delle procedure previste dalla sua legislazione per l'entrata in vigore del presente Accordo. 2. II presente Accordo entrera in vigore alla data della seconda notifica e avra effetto: a) con riferimento alla materia fiscale penale, a partire da tale data; e b) con riferimento a tutte le altre questioni di cui all'articolo 1, a partire da tale data, ma solo in relazione ai periodi d'imposta che iniziano o sono successivi a tale data o, laddove non vi sia alcun periodo d'imposta, per tutte le imposte che insorgono a partire da tale data. Articolo 12 Denuncia 1. Ognuna delle Parti puo denunciare l'Accordo dandone notifica scritta attraverso i pertinenti canali dell'altra Parte come richiesto dalla rispettiva legge.

2. Tale denuncia avra effetto ii prime giorno del mese successive allo scadere di un periodo di sei mesi dalla data in cui l'altra Parte ha ricevuto la notifica di denuncia. 3. In caso di denuncia dell'Accordo, le Parti restano vincolate dalle disposizioni dell'Articolo 8 con riguardo alle informazioni ottenute conformemente al presents Accordo. 12 IN FEDE DI CHE, i sottoscritti, a tal fine debitamente autorizzati, hanno firmato ii presente Accordo. Pasquale Valentini Segretario di State per gli Affari Esteri _, -..'. . -'- '"(~ REPUBLIJ[ INDO SIA AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND THE GOVERNMENT OF REPUBLIC OF SAN MARINO FOR THE EXCHANGE OF INFORMATION RELATING TO TAX MATTERS Whereas the Government of the Republic of Indonesia and the Government of Republic of San Marino (the Parties) wish to enhance and facilitate the terms and conditions governing the exchange of information relating to all tax matters; Now, therefore, the Parties have agreed to conclude the following agreement which contains obligations on the part of the Parties only. Article 1 Object and Scope of the Agreement The competent authorities of the Parties shall provide assistance through exchange of information that is foreseeably relevant to the administration and enforcement of the domestic laws of the Parties concerning taxes covered by this Agreement. Such information shall include information that is foreseeably relevant to the determination, assessment, enforcement, collection or recovery of such taxes, with respect to persons subject to such taxes, or to the investigation of tax matters or the prosecution of criminal tax matters in relation to such persons. Information shall be exchanged in accordance with the provisions of this Agreement and shall be treated as confidential in the manner provided in Article 8. The rights and safeguards secured to persons by the laws or administrative practice of the requested Party remain applicable to the extent that they do not unduly prevent or delay effective exchange of information. 2 Article 2 Jurisdiction A requested Party is not obligated to provide information which is neither held by its authorities nor in the possession of or in the control of or obtainable by persons who are within its territorial jurisdiction. 3 Article 3 Taxes Covered 1. The taxes which are the subject of this Agreement are: a) in Indonesia: (i) the income tax; (ii) the value added tax; b) in the Republic of San Marino: (i) the General Income Tax which is levied (IGR) aa) on individuals; bb) on bodies corporate and proprietorship; (ii) the Import Tax (lmposta Monofase sulle importazioni). 2. This Agreement shall also apply to any identical taxes imposed after the date of signature of the Agreement in addition to or in place of the existing taxes, or any substantially similar taxes imposed after the date of signature of the Agreement in addition to or in place of the existing taxes if the competent authorities of the Parties so agree. The competent authorities of each Party shall notify the other of .any substantial changes to the taxation and related information gathering measures covered by the Agreement. 4 Article 4 Definitions

1. For the purposes of this Agreement the term: a) "Indonesia" comprises the territory of the Republic of Indonesia as defined in its laws, and parts of the continental shelf, exclusive economic zone and adjacent seas over which the Republic of Indonesia has sovereignty, sovereign rights or jurisdiction in accordance with the United Nations Convention on the Law of the Sea 1982; b) "Republic of San Marino", when used in a geographical sense, means the territory of the Republic of San Marino, including any other area within which the Republic of San Marino, in accordance with international law, exercises sovereign rights or jurisdiction; c) "competent authority" means i) in the case of the Republic of Indonesia, the Minister of Finance or his/her authorized representative; ii) in the case of Republic of San Marino, the Minister of Finance or his/her authorized representative; d) "person" includes a natural person, a legal person or any body or group of persons; e) "company" means any body corporate or any entity that is treated as a body corporate for tax purposes; 5 f) "publicly traded company" means any company whose principal class of shares is listed on a recognised stock exchange provided its listed shares can be readily purchased or sold by the public. Shares can be purchased or sold "by the public" if the purchase or sale of shares is not implicitly or explicitly restricted to a limited group of investors; g) "principal class of shares" means the class or classes of shares representing a majority of the voting power and value of the company; h) "recognised stock exchange" means any stock exchange agreed upon by the competent authorities of the Parties; i) "collective investment fund or scheme" means any pooled investment vehicle, irrespective of legal form . The term "public collective investment fund or scheme" means any collective investment fund or scheme provided the units, shares or other interests in the fund or scheme can be readily purchased, sold or redeemed by the public. Units, shares or other interests in the fund or scheme can be readily purchased, sold or redeemed "by the public" if the purchase, sale or redemption is not implicitly or explicitly restricted to a limited group of investors; j) "tax" means any tax to which the Agreement applies; k) "requesting Party" means the Party requesting information; I) "requested Party" means the Party requested to provide information; m) "information gathering measures" means laws and administrative or judicial procedures that enable a Party to obtain and provide the requested information; 6 n) "information" means any fact, statement, document or record in any form whatever; o) "criminal tax matters" means tax matters involving intentional conduct whether before or after the entry into force of this Agreement which is liable to prosecution under the criminal laws of the requesting Party; p) "criminal laws" means all criminal laws designated as such under domestic law irrespective of whether contained in the tax laws, the criminal code or other statutes. 2. As regards the application of this Agreement at any time by a Party, any term not defined therein shall, unless the context otherwise requires, have the meaning that it has at that time under the laws of that Party, any meaning under the applicable tax laws of that Party prevailing over a meaning given to the term under other laws of that Party. 7 . Article 5 Exchange of Information Upon Request

1. The competent authority of the requested Party shall provide upon request by the requesting Party information for the purposes referred to in Article 1. Such information shall be exchanged without regard to whether the requested Party needs such information for its own tax purposes or the conduct being investigated would constitute a crime under the laws of the requested Party if such conduct occurred in the territory of the requested Party. The competent authority of the requesting Party shall only make a request for information pursuant to this Article when it is unable to obtain the requested information by other means, except where recourse to such means would give rise to disproportionate difficulty.

2. If the information in the possession of the competent authority of the requested Party is not sufficient to enable it to comply with the request for information, the requested Party shall use at its own discretion all relevant information gathering measures necessary to provide the requesting Party with the information requested, notwithstanding that the requested Party may not need such information for its own tax purposes.

3. If specifically requested by the competent authority of the requesting Party, the competent authority of the requested Party shall provide information under this Article, to the extent allowable under its domestic laws, in the form of depositions of witnesses and authenticated copies of original records.

4. Each Party shall ensure that its competent authorities for the purposes specified in Article 1 and in accordance with Article 2 of the Agreement, have the authority to obtain and provide upon request: 8 a) information held by banks, other financial institutions, and any person including nominees and trustees, acting in an agency or fiduciary capacity; b) (i) information regarding the legal and beneficial ownership of companies, partnerships, and other persons, including ownership information on all such persons in an ownership chain; (ii) in the case of trusts, information on settlers, trustees, protectors and beneficiaries; (iii) in the case of foundations, information on founders, members of the foundation council and beneficiaries; and (iv) in the case of collective investment schemes, information on shares, units and other interests; provided that this Agreement does not create an obligation on either Party to obtain or provide ownership information with respect to publicly traded companies or public collective investment funds or schemes unless such information can be obtained without giving rise to disproportionate difficulties.

5. Any request for information shall be formulated with as much as detail as possible and shall specify in writing: (a) the identity of the person under examination or investigation; (b) the period for which the information is requested; (c) the nature of the information requested and the form in which the requesting Party would prefer to receive it; 9 (d) the tax purpose for which the information is sought; (e) the reasons for believing that the information requested is foreseeably relevant to tax administration and enforcement of the requesting Party, with respect to the person identified in subparagraph (a) of this paragraph; (f) grounds for believing that the information requested is held by the requested Party or is in the possession of or in the control of or obtainable by a person within the territorial jurisdiction of the requested Party; (g) to the extent known, the name and address of any person believed to be in the possession of or in the control of or able to obtain the requested information; h) a statement that the request is in conformity with the laws and administrative practices of the requesting Party, that if the requested information was within the jurisdiction of the requesting Party, then the competent authority of the requesting Party would be able to obtain the information under the laws of the requesting Party or in the normal course of administrative practice and that it is in conformity with this Agreement; (i) a statement that the requesting Party has pursued all means available in its own territory to obtain the information, except those that would give rise to disproportionate difficulties.

6. The competent authority of the requested Party shall acknowledge receipt of the request to the competent authority of the requesting Party and shall use its best endeavours to forward the requested information to the requesting Party with the least reasonable delay. 10 Article 6 Tax Examinations Abroad (1) By reasonable notice given in advance, the requesting Parties may request that the requested Party allow representatives of the competent authority of the requesting Party to enter the territory of the requested Party, to the extent permitted under its laws, to interview individuals and examine records with the prior written consent of the individuals or other persons concerned. The competent authority of the requesting Party shall notify the competent authority of the requested Party of the time and place of the intended meeting with the individuals concerned. (2) At the request of the competent authority of one Party, the competent authority of the other Party may allow representatives of the competent authority of the first-mentioned Party to be present at the appropriate part of a tax examination in the second-mentioned Party; (3) If the request referred to in paragraph 2 is acceded to, the competent authority of the Party conducting the examination shall, as soon as possible, notify the competent authority of the other Party about the time and place of the examination, the authority or official designated to carry out the examination and the procedures and conditions required by the first-mentioned Party for the conduct of the examination. All decisions with respect to the conduct of the tax examination shall be made by the Party conducting the examination. 11 Article 7 Possibility of Declining a Request

1. The competent authority of the requested Party may decline to assist: (a) where the request is not made in conformity with this Agreement; (b) where the requesting Party has not pursued all means available in its own territory to obtain the information, except where recourse to such means would give rise to disproportionate difficulty; or (c) where the disclosure of the information requested would be contrary to the public policy of the requested Party.

2. This Agreement shall not impose upon a Party any obligation to provide items subject to legal privilege as provided for under the domestic law of the relevant Party, or any trade, business, industrial, commercial or professional secret or trade process, provided that information described in Article 5 paragraph (4) shall not by reason of that fact alone be treated as such a secret or trade process.

3. A request for information shall not be refused on the ground that the tax claim giving rise to the request is disputed.

4. The requested Party shall not be required to obtain and provide information which the requesting Party would be unable to obtain under its own laws for the purpose of the administration or enforcement of its own tax laws or in response to a valid request made in similar circumstances from the requested Party under this Agreement.

5. The requested Party may decline a request for information if the information is requested by the requesting Party to administer or enforce a provision of the 12 tax law of the requesting Party, or any requirement connected therewith, which discriminates against a national of the requested Party as compared with a national of the requesting Party in the same circumstances. 13 Article 8 Confidentiality

1. All information provided and received by the competent authorities of the Parties shall be kept confidential.

2. Information provided to the competent authority of the requesting Party may not be used for any purpose other than the purposes stated in Article 1 without the prior express written consent of the requested Party.

3. Information provided shall be disclosed only to persons or authorities (including judicial and administrative authorities) concerned with the purposes specified in Article 1 and used by such persons or authorities only for such purposes including the determination of any appeal. For these purposes, information may be disclosed in public court proceedings or in judicial decisions.

4. The information provided to a requesting Party under this Agreement may not be disclosed to any other jurisdiction. 14 Article 9 Costs Unless the competent authorities of the Parties otherwise agree, ordinary costs incurred in providing assistance shall be borne by the requested Party, and extraordinary costs in providing assistance (including reasonable costs of engaging external advisers in connection with litigation or otherwise) shall be borne by the requesting Party. The respective competent authorities shall consult as necessary with regard to this Article, and in particular the competent authority of the requested Party shall consult with the competent authority of the requesting Party in advance if the costs of providing information with respect to a specific request are expected to be significant. 15 Article 10 Mutual Agreement Procedure 1 . Where difficulties or doubts arise between the Parties regarding the implementation or interpretation of the Agreement, the competent authorities shall endeavour to resolve the matter by mutual agreement.

2. In addition to the agreements referred to in paragraph 1, the competent authorities of the Parties may mutually agree on the procedures to be used under Articles 5, 6 and 9.

3. The competent authorities of the Parties may communicate with each other directly for the purposes of reaching agreement under this Article.

4. The Parties may also agree on other forms of dispute resolution should this become necessary. 16 Article 11 Entry into Force

1. Each Party shall notify to the other in writing the completion of the procedure required by its law for the entry into force of this Agreement.

2. This Agreement shall enter into force on the date of the later of these notifications and shall thereupon have effect: (a) for criminal tax matters on that date; and (b) for all other matters covered in Article 1 on that date, but only in respect of taxable periods beginning on or after that date or, where there is no taxable period , all charges to tax arising on or after that date. 17 Article 12 Tennination

1. Either Party may terminate the Agreement by serving a written notice of termination through the relevant channels of the other Party required by its respective law.

2. Such termination shall become effective on the first day of the month following the expiration of a period of six months after the date of receipt of notice of termination by the other Party.

3. If the Agreement is terminated the Parties shall remain bound by the provisions of Article 8 with respect to any information obtained under this Agreement. In witness whereof, the undersigned, being duly authorised thereto have signed the Agreement. DONE at New York on the 25th day of September 2013 in 2 (two) identical originals each in the Indonesian, Italian and English languages, all texts being equally authoritative.
